RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached fifth amendment to the professional services agreement with Morrison Structures, Inc. regarding the provision of engineering services for the Mattole Road Bridge (04C-055) over the Mattole River at Honeydew; and

2.                     Direct the Clerk of the Board to return one (1) fully executed original copy of the attached fifth amendment to the professional services agreement with Morrison Structures, Inc. to the Department of Public Works for further processing.

DISCUSSION:

On Jan. 24, 2012, the Humboldt County Board of Supervisors (“Board”) authorized the execution of a professional services agreement with Morrison Structures, Inc. regarding the provision of design engineering and environmental document development services needed to prepare bridge replacement plans for the Mattole Road Bridge (04C-055) over the Mattole River at Honeydew.

 

On May 13, 2014, the Board approved the first amendment to the professional services agreement with Morrison Structures, Inc. which extended the deadline for delivery of services from February 13, 2013 to March 31, 2016.  This extension was necessary to allow for the preparation of certain environmental and historical documents that are needed to facilitate completion of Phases I and II of the project. 

 

On March 22, 2016, the Board approved the second amendment to the professional services agreement with Morrison Structures, Inc. which further extended the deadline for delivery of services to March 31, 2019.  This additional extension was due to the historical eligibility of the Honeydew Bridge and preparation of a joint Environmental Assessment and Environmental Impact Report.  These documents were determined necessary to comply with the requirements of the National Environmental Policy Act and the California Environmental Quality Act.

On Sept. 20, 2016, the Humboldt County Department of Public Works (“Public Works”) executed an agreement with Stantec Consulting Service, Inc., formerly known as North State Resources, Inc., to assist in the development of the joint Environmental Assessment and Environmental Impact Report.  The Board subsequently approved the third amendment to the professional services agreement with Morrison Structures, Inc. which designated Stantec Consulting Service, Inc. as the entity which Morrison Structures, Inc. must assist in the development of the joint Environmental Assessment and Environmental Impact Report, on Dec. 6, 2016. 

 

On April 19, 2022, the Board approved the fourth amendment to the professional services agreement with Morrison Structures, Inc. which increased the maximum amount payable for the services needed to finalize bridge design, provide bid phase assistance and provide environmental and permitting support.   The increase also cover compensation for additional design services due to the higher level environmental documentation, additional alternative bridge type studies, construction impact analysis, recent changes to the California Department of Transportation (“Caltrans”) seismic design codes, and changes to Caltrans review and approval processes.

 

The attached fifth amendment to the professional services agreement with Morrison Structures, Inc. further increases the maximum amount payable by $61,000. This amendment covers the services needed to revise the structure type selection report and revise the final bridge design per requirements made by California Department of Transportation’s Bridge review.  Accordingly, Public Works recommends that the Board, and authorize the Chair of the Board to execute, the attached fifth amendment to the professional services agreement with Morrison Structures, Inc.

Narrative Explanation of Financial Impact:

The attached fifth amendment to the professional services agreement with Morrison Structures, Inc. will increase the maximum amount payable by $61,000 for a total contract amount of $756,000.  The Federal Highway Administration Highway Bridge Program will provide 88.53% of the funding needed to cover the costs associated with Professional Services Agreement. The remaining 11.47% is funded by the Humboldt County Roads Division. 

 

Expenditure appropriations related to the attached fifth amendment to the professional services agreement with Morrison Structures, Inc., have been included in the approved fiscal year 2022-2023 budget for the Road Fund budget unit 1200321-2118.

 

Projects are paid in arrears. The FY 2021-22 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $8.8 million in the county’s Road Fund. Even after allocating nearly $6.8 million of American Rescue Plan Act (ARPA) funds to the Road Fund in order to reduce the negative fund balance, the current estimated fund balance remains negative by approximately $11 million.

 

This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The current outstanding repayments is approximately $11.5 million.  The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects.  Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

 

STAFFING IMPACT:

There is no impact to current staffing levels related to the approval of the fifth amendment to the professional services agreement with Morrison Structures, Inc. regarding the provision of engineering services for the Mattole Road Bridge (04C-055).

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to approve the attached fifth amendment to the professional services agreement with Morrison Structures, Inc. regarding the provision of engineering services for the Mattole Road Bridge (04C-055) over the Mattole River at Honeydew.  However, this alternative is not recommended because Public Works does not have the technical staff to revise and finalize the bridge design plans as required by California Department of Transportation.
