RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Director of Public Works to execute, the attached Contract Change Order Number 2-Supplement 1 for Contract Number 217207 (Post Mile 36.06) for the total amount of $20,758.26 (4/5 Vote Required);

2.                     Accept the completed contracts, including all change orders approved by the Public Works Department, between Wahlund Construction, Inc., and Humboldt County for construction of Storm Damage Repairs to Mattole Road (F3C010) Post Miles 36.06 and 36.16; and

3.                     Approve the final claims for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $20,758.26 for Post Mile 36.06 and $280.00 for Post Mile 36.16, which will bring the total amounts paid to 100 percent of the contracts.

DISCUSSION:

On March 7, 2017, the Governor of the State of California declared a disaster for Humboldt County due to severe winter storms, flooding, and mudslides. Mattole Road (F3C010) Post Miles 36.06 and 36.16, near the city of Ferndale in the southwestern portion of Humboldt County, experienced roadway settlement and shoulder failure. Emergency temporary repairs were performed at the time of the disaster to maintain essential traffic.

 

On Nov. 19, 2020, and Nov. 26, 2020, the Humboldt County Department of Public Works ("Public Works") received Federal Highway Administration funding approval to proceed with the Mattole Road (F3C010) Post Miles 36.06 and 36.16 Storm Damage Repair Project. GHD, Inc. and Public Works prepared plans and specifications for the project based on topographic surveys of the damaged area prepared by Points West Surveying Company and geotechnical studies prepared by Crawford and Associates. The work consisted of reconstructing the roadway embankment and roadbed with geosynthetic material, constructing a rock buttress, installing sub-drainage and storm drainage systems, restoring the roadway to original width, and adding sediment and erosion control items.

 

On March 23, 2021, the Board of Supervisors authorized the Clerk of the Board to advertise the Mattole Road (F3C010) Post Miles 36.06 and 36.16 Storm Damage Repair Project for bids. On April 27, 2021, the county received four (4) bids for the project. The contracts were awarded to Wahlund Construction, Inc., the lowest responsive bidder, on May 25, 2021. The award amount was $1,559,613.46. Contract change orders executed during the project increased the authorized amount of Contract Number 217207 (Post Mile 36.06) by $132,930.01 and increased the authorized amount of Contract Number 217433 (Post Mile 36.16) by $39,233.24. These increases exceed the authorized contingency by $16,163.25 and are due to costs associated with installing survey monuments, mitigating conflicts with existing subsurface drainage facilities, and repairing newly constructed slopes and ditches damaged by high intensity rainfall events in December 2021.

 

The Department of Public Works recommends that the Board of Supervisors approve, and authorize the Director of Public Works to execute, the attached Contract Change Order Number 2-Supplement 1 for Post Mile 36.06; accept the completed contracts, including all change orders approved by Public Works for this project; and approve the final claims for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are $1,731,776.71. Progress payments totaling $1,067,399.66 have been paid for Post Mile 36.06, and the final claim for payment in the amount of $20,758.26 is outstanding. Progress payments totaling $643,338.79 have been paid for Post Mile 36.16, and the final claim for payment in the amount of $280.00 is outstanding.

 

This project was funded through Federal Highway Administration (FHWA) Emergency Relief Funds (88.53%) and the Humboldt County Road Fund (11.47%). Expenditure appropriations relating to completion of the Mattole Road (F3C010) Post Miles 36.06 and 36.16 Storm Damage Repair Project are included in the approved fiscal year 2022-2023 Road Fund Budget.

 

Projects are paid in arrears with anticipated funding coming from FHWA as mentioned above. The fiscal year 2020-21 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $5.9 million. This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the 11.47% Humboldt County Road Fund match for FHWA projects. Despite those additional funding sources, Road Fund projects are underfunded and will have a negative impact on the General Fund if additional revenue sources are not secured.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the project. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contracts.
