RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Director of Public Works to execute, the attached Contract Change Order Number 3 for the total amount of $3,000 (4/5 Vote Required);

2.                     Accept the completed contract, including all change orders approved by the Public Works Department, between Kernen Construction and Humboldt County for construction of the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project; and

3.                     Approve the final claim for payment, to be submitted by the Public Works Department to the Auditor-Controller, in the amount of $3,000, which will bring the total amount paid to 100% of the contract.

DISCUSSION:

The Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project provides bicycle and pedestrian safety improvements between Bella Vista Road and Mill Creek at the southerly end of McKinleyville. The previous shoulder widths on this portion of Central Avenue were narrow and dangerous for all users.

 

On Feb. 9, 2022, the Humboldt County Department of Public Works ("Public Works") received funding allocation approval from the California Department of Transportation to proceed with the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project. Public Works subsequently prepared plans and specifications for the project. The work consisted of clearing and grubbing, excavating for the shoulder widening, installing a storm drain system, constructing a gabion wall, paving with hot mix asphalt, placing thermoplastic striping, and installing erosion control measures.

 

On March 22, 2022, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project for bids.  On April 26, 2022, the County of Humboldt received six (6) bids for the project. The project agreement was awarded to Kernen Construction, the lowest responsive bidder, on May 24, 2022. The award amount was $259,999.84, and contract change orders executed during the project increased the authorized amount by $15,736.59. This increase exceeds the authorized contingency by $2,736.43 and is due to costs associated with replacing centerline striping damaged by construction equipment, extending the new gabion wall to conform to field conditions, and additional erosion control measures to stabilize disturbed soil.

 

Public Works recommends that the Board of Supervisors: approve, and authorize the Director of Public Works to execute, Contract Change Order Number 3; accept the completed contract, including all change orders approved by Public Works for this project; and approve the final claim for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are $275,736.43. Progress payments totaling $272,736.43 have been paid, and the final claim for payment in the amount of $3,000 is outstanding. This project is funded by California Department of Transportation’s State Transportation Improvement Program (100%). The Humboldt County Road Fund is responsible for costs associated with the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project that exceed the total amount allocated by the California Department of Transportation, which is $265,000. Expenditure appropriations relating to completion of the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project are included in the approved fiscal year (FY) 2022-23 Road Fund Budget (1200321-2118).

 

Projects are paid in arrears with anticipated funding coming from the State of California as mentioned above. The FY 2020-21 Annual Road Report, completed by the State of California, reflected an estimated negative fund balance of $5.9 million in the county’s Road Fund. This negative balance is partially due to the timing of Federal Emergency Management Agency reimbursements to the county, which can take years for the county to receive repayment. The department utilizes other state and local funding, such as Regional Surface Transportation Program funds, for the Humboldt County Road Fund match for reimbursable projects. Despite those additional funding sources, Road Fund projects are underfunded and will very likely have a negative impact on the General Fund if additional revenue sources are not secured.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the Central Avenue (4L800) Post Mile 0.00-0.30 Shoulder Widening Project. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contract.
