RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Authorize the Sheriff, or a designee thereof, to enter into negotiations with Integrated Security Controls, Inc. regarding the upgrade and replacement of the current security controls system for the Humboldt County Correctional Facility;

2.                     Authorize the Sheriff, or a designee thereof, to enter negotiations with the one remaining alternate vendor if negotiations with Integrated Security Controls, Inc. are unsuccessful; and

3.                     Direct the Sheriff’s Office staff to return to the Board once negotiations are completed requesting authorization to enter into a negotiated contract for security system replacement and maintenance with Integrated Security Controls, Inc.

DISCUSSION:

The Humboldt County Correctional Facility (HCCF) opened in 1995 and is over 23 years old. One area that the facility would like to upgrade is the security system. HCCF has had the same security system and vendor since 2001 with only minor upgrades. HCCF can only record on 32 of the 80+ cameras that are located throughout the facility. Of the 32 working cameras, several of them do not cover the necessary areas, or provide a good view of housing units, leaving several blind spots in each unit. The current system has left HCCF unable to meet the Prison Rate Elimination Act (PREA) compliance standards due to many uncovered areas or covered areas that aren’t recorded.  Due to these deficiencies, an incident would only be captured if a Correctional Deputy happened to be monitoring it at the time.

 

HCCF’s contract with the current vendor expires on July 1, 2019. HCCF recently circulated a Request for Proposal (Attachment 1) to obtain a new vendor to upgrade the entire system. HCCF selected Integrated Security Controls, Inc. (ISC) as the vendor who best meets HCCF’s needs based on the scoring matrix (Attachment 2).

 

To offset the cost of the security upgrade, HCCF is requesting funding from the US Marshall’s Office under 18 US Code 4013(b) which states: “The Attorney General, in support of Federal prisoner detainees in non-Federal institutions, is authorized to make payments, from funds appropriated for state and local law enforcement assistance, for entering into contracts or cooperative agreements with any state, territory, or political subdivision thereof, for the necessary construction, physical renovation, acquisition of equipment, supplies, or materials required to establish acceptable conditions of confinement and detention services in any state or local jurisdiction which agrees to provide guaranteed bed space for Federal detainees within that correctional system, in accordance with regulations which are issued by the Attorney General and are comparable to the regulations issued under section 4006 of the title”.

 

FINANCIAL IMPACT:

The total cost of the security system upgrade (including the jail expansion) as proposed in the scope of work/cost from Integrated Security Controls, Inc. is $2,082,646 (Attachment 4). The cost for replacement of the system in the existing jail is $1,413,669. The remaining $668,947 is for the security system for the jail expansion which isn’t expected to be completed until the year 2020 or later.

 

The Sheriff’s Office, in collaboration with the CAO’s office, has determined that $200,000 from the Inmate Welfare Fund will be used to provide upfront funding for the project, with the remaining balance to be included in the 2019 Finance Plan, which is currently in development. At the Fiscal Year 2019-20 first quarter budget report, staff may recommend additional funding from the General Fund and/or other funding sources such as trust funds, for this project. HCCF is seeking reimbursement from the US Marshall’s Office up to the amount of $1,413,699. However, the US Marshall’s Office has not guaranteed funding at this time.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to authorize the Sheriff or designee to enter into negotiations however, this is not recommended because failure to upgrade the outdated security system has the potential to create unnecessary liability for the county by reducing the county’s ability to defend itself against fraudulent claims. Additionally it will allow us to promptly detect and remedy any misconduct.
