RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Find that the grant of a public utility easement over Watson Drive (Attachment 1) is in the public interest and that the easement will not substantially conflict or interfere with the county's use of the property;
2. Approve the following Supplemental Budget for a water improvement project (4/5 vote required):
Revenue
1100243-9101 Transfer In $2,500.00
Expenditure
1100243-2113 Maintenance Structures $2,500.00
3. Execute the easement deed to City of Eureka (Attachment 2) in the presence of a notary; and
4. Direct the Clerk of the Board to transmit the executed deed to the Public Works Land Use Division for further processing.

DISCUSSION:
On February 26, 1985, the County of Humboldt conveyed property, commonly known as the dog park (APN 013-101-006 and 013-101-007), to the City of Eureka. As part of that conveyance, the county granted an ingress/egress easement over Watson Drive, which is a private road owned in fee by the County of Humboldt, as the primary access to the property. The easement did not include utilities.

City of Eureka has notified the county that a utility easement over the county-owned portion of Watson Drive (APN 013-111-003) is required in order to install a water line to serve both the city's dog park and the Sheriff's wood lot properties. The construction of the new juvenile hall facility on APN 013-101-010 has changed the existing water service to both the dog park and wood lot facilities, necessitating the new utility easement.
