DISCUSSION:

In 2023, the Board of Supervisors awarded Request for Proposal (RFP) No. SHF-22 to North River Boats for the provision of the HCSO’s Patrol Boat and Trailer. The boat has been delivered, and the payment is now due.

 

At the time of the award, the plan was to allocate the necessary funds for the total purchase price of a boat within the fiscal year (FY) 2023-24. The payment was to be made in two equal installments, with the first 50% due upon finalization of the hull build-out and inspection and the second 50% due upon the final delivery of the boat. However, due to supply chain issues, the delivery timeframe was delayed to the beginning of July 2024. Consequently, the first payment was budgeted for FY2023-24, with the expectation that the hull build-out and inspection would be completed by December 2023. The final payment was to be made upon delivery in July 2024, spanning two fiscal years.

 

The challenges in the supply chain were resolved expeditiously, surpassing initial expectations and resulting in the completion of the construction ahead of the revised schedule. Upon completion of a hull inspection, North River Boats waived the initial 50% payment requirement due to the faster-than-anticipated progress of the build. The vessel underwent successful sea trials, and HCSO accepted delivery on March 5, 2024.

A request for a supplemental budget is required so full payment of the boat can be made in FY 2023-24.

Narrative Explanation of Financial Impact:

As described in the discussion, the supplemental budget will increase appropriations by $200,526.00 into FY 2023-24 to finalize payment for the boat. The supplemental budget will increase the federal revenue awarded by the DHS Port Security Grant (1100221901-4555) by $167,698 and transfer in from asset forfeiture $32,828. (3642).

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Should the Board deny acceptance of the supplemental budget, HCSO would be obligated to relinquish the established grant funding and return the boat. This forfeiture of grant funds could negatively affect future grant requests from both the U.S. Department of Justice and the U.S. Department of Homeland Security.
