RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve acceptance of the Byrne JAG Local Award for 2023;
2. Approve and authorize the Chair to sign the resolution (Attachment 1) authorizing the Sheriff’s Office to submit the governing body resolution for the Byrne JAG 2023 program, accept grant funds, and sign any documents required for participation in the grant program;
3. Approve the Supplemental Budget request for budget unit 1100-221911 - Byrne JAG Local 2023 Grant (Attachment 2) (4/5 vote required);
4. Authorize the Sheriff, Undersheriff or Sheriff’s Deputy Director of Financial and Support Services to sign all future amendments, terminations, extensions, and documents directly related to the Edward Byrne Memorial JAG Program Local Award 2023 upon review of County Counsel, Risk Management and the County Administrative Office; and
5. Direct the Clerk of the Board to return completed and signed copy of the Resolution to the Sheriff’s Office, Attention: Julie Martin for submittal to funding agency.

DISCUSSION:
The Edward Byrne Memorial Justice Assistance Grant (JAG) program was authorized under 34 U.S.C. §§ 10151 - 10158 to provide funding to state and local jurisdictions. Some of the program’s focus areas are: law enforcement, prosecution, indigent defense, courts, crime prevention and education, and corrections and community corrections. This funding is offered through annual solicitations. The Humboldt County Sheriff’s Office (HCSO) has been awarded JAG funding under different programs for many years. The 2018 grant cycle was the first time the Sheriff’s Office applied for and received funding under the Local Solicitation and has applied for and received this funding ever since.
The Humboldt County Sheriff's Office (HCSO) has been awarded the JAG Program Local Grant 2023 to reduce funds needed from asset forfeiture for HCSO’s new patrol boat under contract with North River Boats. HCSO received the maximum allowable award amount of $23,071 and there is no match requirement needed for this grant.
The patrol boat purchase was originally approved by the Board on Jan. 25, 2022 with Port Security grant funds of $236,250 and Sheriff’s Asset Forfeiture Fund 3642 match of $78,750. The Board approved to issue the Request for Proposal for the patrol boat on Aug. 16, 2022. Finally, on Jan. 10, 2023 the Board approved the boat contract with North River Boats for a total of $447,194 with additional funds from Sheriff’s Asset Forfeiture Fund 3642 to complete the purchase. The budget for the Port Security Grant for FY2023-24 was budgeted for the boat contract amount less the deposit that was anticipated to be paid in FY2022-23. That deposit was not required and therefore the full amount of the boat will be paid in FY2023-24. A separate agenda item will come to your board for the additional supplemental budget necessary to finish the purchase of the boat.

Narrative Explanation of Financial Impact:
These funds will complement the Port Security Grant for the new patrol boat build currently under contract with North River Boats. The expected delivery of the new boat is June 2024, and these funds will not be used as the 25% match required under the Port Security Grant. Instead, they will be utilized to reduce the amount needed from asset forfeiture to offset the outstanding difference between the total build for the boat (which is $447,194) minus the Port Security Grant (which is $236,250) and the required Match (which is $78,750). The JAG Program Local Award will significantly reduce the funds needed from asset forfeiture to pay the remaining balance, from $132,194 to $109,123.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Should the Board deny acceptance of Byrne JAG Local grant funds and supplemental budgets, then HCSO would need to forfeit the grant award.
