RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached memorandum of understanding with Redwood Coast Regional Center regarding the provision of mental health services to individuals that have been diagnosed with developmental disability and mental illness for the period of July 1, 2023 through June 30, 2026;

2.                     Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached memorandum of understanding with Redwood Coast Regional Center, after review and approval by County Counsel Risk Management and the County Administrative Office;

3.                     Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all additional nursing personnel agreements needed to effectuate the terms and conditions of the attached memorandum of understanding with Redwood Coast Regional Center, after review and approval by County Counsel, Risk Management and the County Administrative Office; and

4.                     Direct the Clerk of the Board to return one (1) executed copy of this item to the Department of Health and Human Services - Contract Unit.

DISCUSSION:

In 2004, the California Department of Health Care Services, encouraged county mental health departments throughout the state to collaborate with local regional centers in providing appropriate mental health services to individuals that have been dually diagnosed with developmental disability and mental illness.

 

In 2006, the County of Humboldt entered into a Memorandum of Understanding (“MOU”) with Redwood Coast Regional Center (“RCRC”) for the provision of mental health services to dually diagnosed clients. The agreement was renewed in 2017 and again in 2020 and expired June 30, 2023.

The attached MOU provides an additional three (3) year term, identifies staff that will be responsible for the coordination and development of a general plan for crisis intervention and psychiatric hospitalization services, and provides for interagency training, dispute resolution, and annual review as required by the California Welfare and Institutions Code.  The attached MOU also clarifies the financial responsibilities of DHHS - Behavioral Health and RCRC for clients who no longer meet the criteria for medical necessity.  This MOU is being presented late to the Board, due to inadvertent delays with regard to the development of mutually agreed upon content. 

 

Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the DHHS - Behavioral Health Director, or designee thereof, to execute the attached MOU with RCRC for the provision of mental health services to individuals that have been diagnosed with developmental disability and mental illness.  It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and additional nursing personnel agreements needed to effectuate the terms and conditions of, the attached MOU with RCRC, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed mental health services.

 

FINANCIAL IMPACT:

Narrative Explanation of Financial Impact:

The memorandum of understanding (MOU) with Redwood Coast Regional Center (RCRC) regarding the provision of mental health services will not require additional revenue or expenditure appropriations.  Operating expenditures have been included in approved budget for fiscal year 2022-2023 DHHS-Behavioral Health Sempervirens/Crisis Stabilization Unit budget unit 1170495 and personnel allocations and revenue associated with this MOU have been included in approved budget for DHHS-Behavioral Health Administration budget unit 1170424.  Funding sources include Federal Financial Participation for Medi-Cal specialty mental health, Behavioral Health Realignment and private payors.  As such, there is no impact to County General Fund.

 

STAFFING IMPACT:

Narrative Explanation of Staffing Impact:

No additional staffing impacts are anticipated as a result of entering into this agreement. The roles and responsibilities of staff, are already incorporated into the workload and have been since 2006.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the attached MOU with RCRC regarding the provision of mental health services to individuals that have been diagnosed with developmental disability and mental illness.  However, this alternative is not recommended since it would not allow for compliance with California Welfare and Institutions Code Section 4696.1(b).
