RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Ratify Change Order 2 in the amount of $10,870.37 and a time extension of 21 days for the Garberville Public Health ADA Modification Project (4/5 Vote Required);

2.                     Accept the work of Adams Commercial General Contracting, Inc. as complete for the Garberville Public Health ADA Modification Project; and

3.                     Authorize the Purchasing Agent to sign the Notice of Completion for the project.

DISCUSSION:

On September 7, 2016, the county entered into a consent decree with the United States Department of Justice (DOJ) that required the commencement of the Humboldt County Americans with Disabilities Act Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services or activities to the public into compliance with the ADA. This project illustrates the county’s continued commitment toward access barrier removal at its facilities.

 

On January 25, 2022, your Board authorized staff to award the Garberville Public Health ADA Modification Project to Adams Commercial General Contracting, Inc. (ACGC) of Eureka, California for the base bid amount of $187,950.  The construction project renovated and removed barriers to access in the single user restrooms making one fully ADA compliant, reconstructed three service counters, replaced the front door and reconstructed the parking lot with one ADA accessible van parking stall and a compliant path of travel linking the facility to the pedestrian right of way as well as the newly constructed Garberville County Complex across the street.

 

On June 14, 2022, your Board authorized Change Order 1 in the amount of $67,916, which added flooring replacement and removal of asbestos containing materials to the project scope.

 

Before your Board today is a request to ratify Change Order 2 in the amount of $10,870.37 which includes the addition of parking bumpers, toilet replacement with a compatible rear drain outlet, the relocation of a detectible warning surface and a credit for toilet accessories provided by the county.

 

ACGC has substantially completed their contract obligations and therefore the project can be accepted as complete in accordance with the contract documents. The Board of Supervisors must accept the project prior to filing final acceptance. After your Board’s acceptance, the required Notice of Completion can be filed with the Humboldt County Recorder and the mandatory 35-day lien period can begin. Following completion of the lien period, the county can release or reduce the payment retention provided that no stop notices have been filed and any remaining contract work has been completed.

 

FINANCIAL IMPACT:

The original contract sum with ACGC of $187,950 with Change Order 1 established a contract value of $255,866. This combined with Change Order 2 in the amount of $10,870.37 establishes a final contract value of $266,736.37 and a final overall project cost of $324,265, which includes all other ancillary expenditures such as design and inspection costs.  The ADA Compliance budget (3552-152) has adequate funding in the current fiscal year to cover costs associated with Change Order 2.

The recommended actions support the Board of Supervisors’ Strategic Framework by fostering transparent, accessible, welcoming and user friendly services and maintains county infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your Board could choose not to ratify Change Order 2, and/or not to approve the Purchasing Agent signing the Notice of Completion for the project.  However, this is not recommended as ACGC has completed Change Order 2 and has completed their contractual obligations and therefor are entitled to release of retention at the conclusion of the 35-day lien period.
