RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached professional services agreement with Shaw Yoder Antwih Schmelzer & Lange, Inc. regarding the provision of state legislative advocacy and representation services for the period of January 1, 2023 through December 31, 2025;

2.                     Approve, and authorize the Chair of the Board to execute, the attached professional services agreement with Paragon Government Relations regarding the provision of federal legislative advocacy and representation services for the period of January 1, 2023 through December 31, 2025;

3.                     Authorize the County Administrative Officer, or a designee thereof, to execute any and all subsequent amendments to the attached professional service agreements with Shaw Yoder Antwih Schmelzer & Lange, Inc. and Paragon Government Relations, after review and approval by County Counsel and Risk Management; and

4.                     Direct the Clerk of the Board to return one (1) fully executed copy of each of the attached professional services agreements with Shaw Yoder Antwih Schmelzer & Lange, Inc. and Paragon Government Relations to the County Administrative Office for further processing.

DISCUSSION:

Shaw Yoder Antwih Schmelzer & Lange, Inc. (“SYASL”), formerly Shaw/Yoder/Antwih, Inc., and  Paragon Government Relations (“PGR”), formerly Waterman & Associates, have been providing state and federal legislative advocacy and representation services for the County of Humboldt for a number of years.  These legislative advocacy and representation services provided by SYASL and PGR include, without limitation, advising the County of Humboldt on matters concerning legislation and pending legislation and advocating on the County of Humboldt’s behalf in Sacramento and Washington D.C. on a year-around basis.  The services provided by SYASL and PGR benefit the County of Humboldt by expediting communications with staff regarding changes in priority issues and representing the interests of the County of Humboldt in Sacramento and Washington D.C.

 

In December 2019, the Humboldt County Board of Supervisors (“Board”) authorized the Chair to execute 3-year contracts with SYASL and PGR, which expired on December 31, 2022.  The attached professional services agreements with SYASL and PGR cover the period of January 1, 2023 through December 31, 2025 and include cost increases to keep pace with the consumer price index and to reflect competitive market rates.  The attached professional services agreements with SYASL and PGR come to the Board after the start date thereof date due to inadvertent delays that occurred during the contract development process.

 

FINANCIAL IMPACT:

The attached professional services agreement with SYASL has a maximum amount payable of Eighty-Eight Thousand Two Hundred Twenty-Four Dollars ($88,224.00) for the period of January 1, 2023 through December 31, 2025.  In no event shall the maximum amount paid under the attached professional services agreement with SYASL exceed Fourteen Thousand Two Hundred Seventy-Four Dollars ($14,274.00) for fiscal year 2022-2023, Twenty-Eight Thousand Nine Hundred Seventy-Four Dollars ($28,974.00) for fiscal year 2023-2024, Twenty-Nine Thousand Eight Hundred Thirty-Eight Dollars ($29,838.00) for fiscal year 2024-2025 and Fifteen Thousand One Hundred Thirty-Eight Dollars and Seventeen Cents ($15,138.00) for fiscal year 2025-2026.  However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with SYASL in its entirety.

 

The attached professional services agreement with PGR has a maximum amount payable of Two Hundred Twenty-Three Thousand Twenty Dollars ($223,020.00) for the period of January 1, 2023 through December 31, 2025.  In no event shall the maximum amount paid under The attached professional services agreement with PGR exceed Thirty-Seven Thousand One Hundred Seventy Dollars (37,170.00) for fiscal year 2022-2023, Seventy-Four Thousand Three Hundred Forty Dollars ($74,340.00) per fiscal year for fiscal years 2023-2024 and 2024-2025 and Thirty-Seven Thousand One Hundred Seventy Dollars (37,170.00) for fiscal year 2025-2026.  However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with PGR in its entirety.

 

Expenditure appropriations related to the attached professional services agreements with SYASL and PGR have been included in the approved fiscal year 2022-2023 budget for County Administrative Office - Management and Budget Team budget unit 1100-103.  Funding for the attached professional services agreements with SYASL and PGR is available from the General Fund allocation to the County Administrative Office - Management and Budget Team.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by facilitating public/private partnerships to solve problems and advancing local interests in natural resource discussions.
