RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and file the bids for California Redwood Coast-Humboldt County Airport (ACV) Runway 14/32 Rehabilitation and Improve Electrical Systems;

2.                     Award the contract to Mercer Fraser Company for the total amount of $16,961,961.00;

3.                     Authorize the Chairperson to execute the construction project agreement with Mercer Fraser, for an amount not to exceed $16,961,961, upon submittal of the appropriate bonds and insurance;

4.                     Authorize the Chairperson to sign four copies of the professional services agreement with Armstrong Consultants, Inc. for construction administration, for an amount not to exceed $1,209,430;

5.                     Authorize the Director of Aviation, or designee thereof, to execute any amendments or successor agreements to the professional services agreement with Armstrong Consultants, Inc. after review by County Counsel, Risk Management, and the County Administrative Office; and

6.                     Direct the Clerk of the Board to return three fully executed copies of the professional services agreement with Armstrong Consultants Inc. to the Department of Aviation.

DISCUSSION:

Construction Contract:

On March 1, 2022, your Board authorized the Clerk of the Board to advertise the above-referenced project for bids.  To meet FAA requirements, the public bidding process was conducted prior to receiving FAA Grant No. 3-06-0010-053-2022.  On March 31, 2022, the county received two bids for the project.  The results were as follows:

Construction Administration Agreement

On November 16, 2021, your Board authorized execution of a professional services agreement for the design of the above-referenced project.  Armstrong was selected from the prequalification list for airport consultants adopted by your Board on April 27, 2021.  The Department of Aviation is requesting your Board to execute the agreement for construction administration services.

 

The FAA requires that airports select engineers and planners to assist with their projects, such as the runway and electrical project being proposed at ACV, based on qualifications.  The County of Humboldt does not have any staff internally that have the engineering expertise to assist Aviation Staff in ensuring that the contractor follows the engineering plan set and meets all FAA requirements throughout the construction process.  Armstrong has been assisting airports, like ACV, for nearly 50 years with said projects.  The only engineering and planning that they do is in the airport field.  The Department of Aviation selected Armstrong based on their qualifications, and experience, thereby complying with the FAA requirements of doing so.  Additionally, the FAA requires airports to conduct an Independent Fee Evaluation (IFE) to ensure that the proposed fees for services rendered are fair and equitable.  The fees of $1,209,430 proposed by Armstrong were 19%, or $229,890.79, lower than the fees that would be charged by a like firm in the department’s IFE analysis.  

 

FINANCIAL IMPACT:

This project is being funded through the Federal Aviation Administration Airport Improvement Program Grant No. 3-06-0010-053-2022, which provides 90.66% of the construction funds.  The Department of Aviation is responsible to cover the remaining 9.34% of project costs.  Construction costs were included in the proposed FY 2022-23 aviation budget, line item 3539170-8851. 

 

Due to the size of this project, and the overall financial impacts, the FAA has granted the County of Humboldt the majority of funding, 80%, with grants issued in FY2022.  The remaining federal shares will be granted in FY2023 through AIP, and funding dedicated to the Humboldt County Airport System through the Bipartisan Infrastructure Law signed by the President of the United States in November 2021.

This action supports your Board’s Strategic Framework by providing for and maintaining infrastructure ; and seeking outside funding sources to benefit Humboldt County needs.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your Board may choose to not to award the construction project and execute the consultant agreement.  However, this alternative is not recommended because it could result in a loss of funding scheduled and provided for by the FAA AIP and cause further deterioration of runway and electrical infrastructure that are already beyond the end of their useful life.
