SUBJECT:
title
Approval of the Northcoast Preparatory Academy Conflict-of-Interest Code
end
RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve Northcoast Preparatory Academy Conflict-of-Interest Code.
Body
SOURCE OF FUNDING:
General Fund (1100)
DISCUSSION:
The California Political Reform Act requires every agency to adopt and promulgate a Conflict-of- Interest Code. Section 87301 provides that it is the policy of the Act that conflict-of- interest codes be formulated at the most decentralized level possible. While the Act itself does not specify what constitutes the most decentralized level for purposes of adopting a conflict-of-interest code, newly adopted Education Code Section 47604 does define that term for charter schools. It states that for purposes of Section 87300 of the Government Code, a charter school and an entity managing a charter school shall be considered an “agency” and is the most decentralized level for purposes of adopting a conflict-of-interest code.
FINANCIAL IMPACT:
There are no costs directly associated with approval of Northcoast Preparatory Academy Conflict-of-Interest Code. As a result, the recommended actions will not impact the Humboldt County General Fund.
OTHER AGENCY INVOLVEMENT:
None
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve Northcoast Preparatory Academy’s Conflict-of-Interest Code. However, this alternative is not recommended as it would leave Northcoast Preparatory Academy with an inaccurate Conflict-of-Interest Code.
