RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize Chair of the Board to execute, the attached Professional Services Agreement with Kimley Horn and Associates, Inc. regarding Per- and Polyfluoroalkyl Substances (PFAS) Materials Testing Equipment; and

2.                     Authorize the Director of Aviation to execute any amendments after review by County Counsel, Risk Management and the County Administrative Office; and

3.                     Direct the Clerk of the Board to return one fully executed original copy of the attached Professional Services Agreement with Kimley Horn and Associates, Inc. to the Department of Aviation.

DISCUSSION:

The Federal Aviation Administration (FAA) requires that 14 C.F.R. Part 139 (Part 139) commercial service airports operate and maintain their Aircraft Rescue and Fire Fighting (ARFF) vehicles with fire suppression operating systems, including the foam proportioning system and discharge functions. Foam proportioning systems are required to be periodically sprayed for testing purposes to meet FAA requirements.

 

On June 23, 2021, the Department of Aviation applied for, and accepted FAA Grant Number 3-06-0010-050-2021 to cover 100% of the cost to acquire new Aqueous Film Forming Foam (AFFF) testing equipment in accordance with FAA regulations, including bid and contract management services. Kimley-Horn will prepare and manage quarterly federal financial reports (SF425) and grant closeout documentation, as well as prepare bid and contract documents for inclusion of technical specifications for the procurement of an ARFF Input-Based Testing Equipment.

 

A Request for Qualifications (RFQ) was conducted in 2021 in accordance with the FAA regulations and was presented to, and approved by, the Board of Supervisors on April 27, 2021.

 

FINANCIAL IMPACT:

The attached professional services agreement with Kimley-Horn has a maximum amount payable for services rendered, and costs and expenses incurred, pursuant to the terms and conditions of the attached Agreement, of $14,168.07.

 

Expenditure appropriations related the attached agreement was included in the recommended Fiscal Year 2022-23 budget for the Aviation Department - Aviation Capital Projects (3539-170). Funding for the attached professional services agreement with Kimely Horn is available via reimbursement through the previously accepted Federal Aviation Administration (FAA), Airport Improvement Program (AIP) Grant, No. 3-06-0010-050-2021 (revenue line 3539170-4565). Therefore, there is no impact to the General Fund.

 

STRATEGIC FRAMEWORK:

This action supports your Board’s Strategic Framework by providing for and maintaining infrastructure and, seeking outside funding sources to benefit Humboldt County needs.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the agreement with Kimley-Horn & Associates, Inc.  However, it is not recommended due to the potential impacts outlined below:

                     The Board would be forfeiting a FAA AIP Grant that will reimburse the County of Humboldt for 100% of costs, up to $70,000, for this project; and

                     The Aviation Department would be in a position of non-compliance with FAA regulatory requirements and grant assurances
