RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Director of Public Works, or a designee thereof, to execute, the attached cover agreement with the California Department of Transportation regarding adjustment to grade of a manhole and valve covers located near the driveway to the Humboldt County Correctional Facility on Fifth Street as part of the State of California’s Conventional Highway Construction Project;
2. Authorize the Director of Public Works, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached cover agreement with the California Department of Transportation, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) certified copy of the Board Order pertaining to this item to the Department of Public Works.

DISCUSSION:
The California Department of Transportation (“Caltrans”) is currently in the process of implementing the California Conventional Highway Construction Project (“Project”) which includes constructing Americans with Disability Act compliant sidewalks, bulb outs and driveways along Fifth Street in Eureka. As part of the Project, a new bulb out in front of the driveway to the Humboldt County Correctional Facility will be installed. The sidewalk surrounding the bulb out will be adjusted upward by 0.1 foot. A manhole owned by the County of Humboldt is located within the affected sidewalk area and will also have to be adjusted upward by 0.1 foot to match the new grade of the sidewalk. The attached cover agreement will allow Caltrans to perform, and pay for, the work associated with adjusting the County of Humboldt’s manhole and valve covers located within the Project area.
Accordingly, the Department of Public Works recommends that the Board approve, and authorize the Director of Public Works, or a designee thereof, to execute the attached cover agreement with Caltrans regarding adjustment to grade of the manhole and valve covers located within the Project area. It is also recommended that the Board authorize the Director of Public Works, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations or documents directly associated with, the attached cover agreement with Caltrans, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the performance of work associated with the adjustment to grade of the manhole and valve covers located within the Project area.
FINANCIAL IMPACT:
Pursuant to the terms and conditions of the attached cover agreement with Caltrans, all of the work associated with the adjustment to grade of the manhole and valve covers located within the Project area will be performed at no cost to the county. As a result, approval of the attached cover agreement with Caltrans will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached cover agreement with Caltrans regarding adjustment to grade of the manhole and valve covers located within the Project area. However, this alternative is not recommended as it would require the County of Humboldt to pay for and perform the work associated with the adjustment to grade of the manhole and valve covers located within the Project area in a timeframe that will not delay completion of the Project.
