RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached memorandum of understanding with Mariane Gilbert regarding payment associated with the provision of non-emergency medical care services;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached memorandum of understanding with Mariane Gilbert after review and approval by County Counsel, Risk Management, and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) fully executed copy of the attached memorandum of understanding with Mariane Gilbert to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
Pursuant to section 77061(d) of Title 22 of the California Code of Regulations, the county's psychiatric health facility, Sempervirens, is required to always have a physician on-call for the provision of non-emergency physical health care. On July 7, 2020, the County of Humboldt entered a professional services agreement with Mariane Gilbert regarding the provision of non-emergency medical care services for patients at Sempervirens for the period of July 1, 2020 through June 30, 2021. Due to inadvertent oversight, monthly invoices were not submitted for March 2021, April 2021, and May 2021 until March 10, 2022. Upon receipt of delayed invoices and due to additional non-emergency medical care services the contract cap was exceeded and an amendment to increase the cap was unable to be completed prior to the expiration of the agreement....
