RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Retroactively approve, and authorize the Chair of the Board and the Sheriff to execute and the Clerk of the Board to attest to the attached Agreement with the City of Blue Lake regarding law enforcement services in the amount of $327,670 for the period of Nov. 1, 2021 to June 30, 2024;
2. Retroactively approve, and authorize the Chair of the Board and the Sheriff to execute and the Clerk of the Board to attest to the attached Agreement with the City of Trinidad regarding law enforcement services in the amount of $327,670 for the period of Nov. 1, 2021 to June 30, 2024;
3. Authorize the Chair of the Board and Sheriff to execute any and all subsequent amendments to the attached Agreements with City of Blue Lake and City of Trinidad after review and approval by County Counsel, Risk Management and the County Administrative Office;
4. Direct the Clerk of the Board to return one fully executed original copy of the attached Agreements with the City of Blue Lake and the City of Trinidad to the Sheriff’s Office for further processing.

DISCUSSION:
The City of Blue Lake (since 2008) and the City of Trinidad (since 2011) (“cities”) has contracted with the Humboldt County Sheriff’s Office (HCSO) to provide law enforcement services to the incorporated areas of their respective city. Due to staffing challenges, HCSO was unable to maintain the level of coverage provided in the most recent agreements and therefore the agreements were in a month-to-month status while the parties discussed the current needs versus the current staffing challenges to come up with a proposed agreement moving forward. On November 1, 2021 the parties agreed to the coverage and service terms of the new agreement. Due to timing of getting the agreements approved by the Boards of the contracted cities and to your Board, HCSO is requesting that they be approved retro-actively to November 1, 2021 to accurately reflect the amount of coverage and services being provided by HCSO to the cities.
The basic level of services to be provided to each city shall consist of 24 hours of coverage from a sworn peace officer 7 days a week for response to calls at a level not less than that provided by the Sheriff in adjacent areas of the county, including related back-up and auxiliary services such as investigative, community services, criminalistics, supervisorial, and traffic service functions. This also includes services and support from the Sheriff’s Support Services Bureau, Property/Evidence, and Public Safety Dispatch services.
Accordingly, HCSO recommends that the Board of Supervisors approve, and authorize the Chair of the Board and the Sheriff to execute and the Clerk of the Board to attest to the attached Agreements with the City of Blue Lake and City of Trinidad regarding law enforcement services in the amount of $327,670 per city for the period of Nov. 1, 2021 to June 30, 2024. Staff also recommends that the Board authorize the Chair of the Board and Sheriff to execute any and all subsequent amendments to the attached Agreements with City of Blue Lake and City of Trinidad after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed law enforcement services.
FINANCIAL IMPACT:
The attached Agreements with City of Blue Lake and City of Trinidad has a total payable of $327,670 per city for the period of Nov. 1, 2021 to June 30, 2024. However, either party may terminate the agreement upon 60 days’ notice. In addition, per the agreement, the rate charged shall be recomputed by June 1 each year for the following fiscal year, and may be formally addressed at any time at the request of either party.
Revenue appropriations related to the attached agreements has been included in the approved FY2021-22 budget for the Sheriff’s Office Blue Lake Station 1100-221240 and Trinidad Station 1100-221230 in object code 880870 Charges for Services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the agreement or allow the Chair of the Board or Sheriff to sign such agreements, however this alternative is not recommended as it will result in the City of Blue Lake and City of Trinidad not having required law enforcement services for their incorporated areas.
