That the Board of Supervisors:
1. Ratify the contract dated Dec. 20, 2021, between Humboldt County and Municipal Services Bureau (MSB)

DISCUSSION:
GovEase, LLC holds a professional services contract for Online Auction Portal services with Humboldt County dated September 21, 2021. GovEase will administer tax sales on behalf of the county in accordance with CA Rev & Tax Code 3691-3731.1. Humboldt County desires for GovEase to facilitate payments for auctions through GovEase’ solution and GovEase utilizes Municipal Services Bureau (MSB) to serve as its vendor to provide an online payment acceptance solution including credit/debit card, E-check and wire transfer of certified funds. MSB is an independent contractor of GovEase.
On December 20, 2021 John Bartholomew signed a contract accepting MSB’s payment processing under the authority granted to a treasurer by State of California code 53682 “Notwithstanding any other provision in this article except Section 53652, the treasurer may deposit moneys in and enter into contracts with any depository, as defined in subdivision (c) of Section 53630, for services to be rendered by that depository that in the treasurer’s judgment are to the public advantage.” Under the advice of counsel, it is recommended that your Board ratify the contract.
FINANCIAL IMPACT:
The county does not have a payment processing solution and not ratifying the contract would prevent the county from holding an online auction. All costs for the auction are recouped through fees paid by the successful bidder on the parcel.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your board may choose not to ratify the attached contract between Humboldt County and Municipal Services Bureau (MSB). This is not recommended because it would prevent successful completion of an online auction of tax defaulted properties.
