RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached professional services agreement with EA Family Services regarding the provision of outreach, engagement, behavioral health treatment and social rehabilitation services as part of the Assisted Outpatient Treatment Program for the period of January 4, 2022 through June 30, 2022;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with EA Family Services, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached professional services agreement with EA Family Services to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
The Assisted Outpatient Treatment Program furthers the purposes of Sections 5345, et seq. of the California Welfare and Institutions Code and all other relevant provisions of California Assembly Bill 1421 and California Assembly Bill 1976. Implementation of the Assisted Outpatient Treatment Program is intended to support the provision of voluntary and court-ordered behavioral health treatment and social rehabilitation services, including, without limitation, assessment, collateral, crisis intervention, medication support, intensive case management, individual and group counseling and substance use disorder treatment services, to individuals who are deemed to pose a significant risk to the community as a result of their mental health diagnosis.
On April 6, 2021, the Humboldt County Board of Supervisors met regarding the decision to either implement, or opt out of implementing, the Assisted Outpatient Treatment Program in Humboldt County. A motion was made to direct the Department of Health and Human Services - Behavioral Health (DHHS - Behavioral Health), in collaboration with the County Administrative Office, to return with a supplemental budget and position allocation to implement the Assisted Outpatient Treatment Program, or a similar type of service program, and request that the state extend the period to opt out of implementing the Assisted Outpatient Treatment Program.
On June 8, 2021, the Board directed DHHS - Behavioral Health to issue a Request for Proposals (RFP) regarding the provision of services that are intended to assist in determining the feasibility of implementing the Assisted Outpatient Treatment Program in Humboldt County. DHHS - Behavioral Health subsequently issued RFP No. DHHS2021-04, which solicited proposals from qualified organizations to provide specified outreach, engagement, behavioral health treatment and social rehabilitation services as part of the program, on October 4, 2021.
DHHS - Behavioral Health received two proposals in response to RFP No. DHHS2021-04. After reviewing and evaluating the proposals in accordance with the applicable evaluation and selection criteria, the RFP evaluation committee decided to select EA Family Services as the organization to provide specified outreach, engagement, behavioral health treatment and social rehabilitation services as part of the Assisted Outpatient Treatment Program. On December 14, 2021, the Board approved the RFP Evaluation Committee’s selection of, and authorized the DHHS - Behavioral Health Director to enter into contract negotiations with, EA Family Services.
The attached professional services agreement with EA Family Services will allow for the provision of outreach, engagement, behavioral health treatment and social rehabilitation services that are designed to modify maladaptive behavior patterns and guide individuals participating in the Assisted Outpatient Treatment Program towards wellness for the period of January 4, 2022 through June 30, 2022. It should be noted that the attached professional services agreement with EA Family Services comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached professional services agreement with EA Family Services regarding the provision of outreach, engagement, behavioral health treatment and social rehabilitation services as part of the Assisted Outpatient Treatment Program for the period of January 4, 2022 through June 30, 2022. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with EA Family Services, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed outreach, engagement, behavioral health treatment and social rehabilitation services.
FINANCIAL IMPACT:
The attached professional services agreement with EA Family Services has a maximum amount payable of $314,332 for the period of January 4, 2022 through June 30, 2022. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with EA Family Services in its entirety.
Expenditure appropriations related to the attached professional services agreement with EA Family Services have been included in the approved fiscal year 2021-2022 budget for DHHS - Behavioral Health Administration budget unit 1170-424. Funding for the attached professional services agreement with EA Family Services is available through federal financial participation for Medi-Cal and County General Fund appropriation, as approved by the Board on June 8, 2021.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health and providing community-appropriate levels of services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached professional services agreement with EA Family Services regarding the provision of outreach, engagement, behavioral health treatment and social rehabilitation services as part of the Assisted Outpatient Treatment Program. However, this alternative is not recommended as it will not allow for the provision of needed services to underserved populations throughout Humboldt County.
