RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached software license and support services agreement with Biometrics4ALL, Inc. regarding the provision, support and maintenance of a California Department of Justice approved electronic finger printing system for the period of July 1, 2021 through June 30, 2026;

2.                     Authorize the Humboldt County Department of Health and Human Services Director, or a designee thereof, to execute any and all subsequent amendments to the attached software license and support services agreement with Biometrics4ALL, Inc., after review and approval by County Counsel, Risk Management and the County Administrative Office; and

3.                     Direct the Clerk of the Board to return one fully executed original copy of the attached software license and support services agreement with Biometrics4ALL, Inc. to the Humboldt County Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:

Biometrics4ALL, Inc. (“Biometrics4ALL”) provides a California Department of Justice approved electronic finger printing system that is used by the Humboldt County Department of Health and Human Services - Social Services (“DHHS - Social Services”) to perform background checks necessary to protect clients, families and employees. The Employee Services division of DHHS - Social Services uses the electronic finger printing system provided by Biometrics4ALL to perform background checks on incoming employees to be compliant with local, state and federal laws, regulations and standards requiring background checks for certain positions.  The Child Welfare Services division of DHHS - Social Services uses the electronic finger printing system provided by Biometrics4ALL to perform background checks on potential foster care parents as mandated for potential placements of children in resource family approval, guardianship and/or tribal approved homes.  DHHS - Social Services’ In-Home Supportive Services Program uses the electronic finger printing system provided by Biometrics4ALL to perform background checks on providers who are enrolling to be care providers for elders and disabled individuals.   

 

The attached software license and support services agreement will allow for the provision, support and maintenance of a California Department of Justice approved electronic finger printing system for the period of July 1, 2021 through June 30, 2026.  It should be noted that the attached software license and support services agreement comes to the Board after the start date due to inadvertent delays that occurred during the contract development process.

 

Accordingly, DHHS  recommends that the Board approve, and authorize the Chair of the Board to execute, the attached software license and support services agreement with Biometrics4ALL regarding the provision, support and maintenance of a California Department of Justice approved electronic finger printing system for the period of July 1, 2021 through June 30, 2026.  It is also recommended that the Board authorize the DHHS Director, or a designee thereof, to execute any and all subsequent amendments to the attached software license and support services agreement, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision, support and/or maintenance of a California Department of Justice approved electronic finger printing system.

 

FINANCIAL IMPACT:

The attached software license and support services agreement has a maximum amount payable of $75,150 for the period of July 1, 2021 through June 30, 2026.  In no event shall the maximum amount paid under the attached software license and support services agreement with Biometrics4ALL exceed $15,030 per fiscal year for fiscal years 2021-2022 through 2025-2026.  However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached software license and support services agreement With Biometrics4ALL in its entirety.

 

Expenditure appropriations related to the attached software license and support services agreement have been included in the approved fiscal year 2021-2022 for DHHS - Social Services budget units 1160-508, 1160-511 and 1160-511004.  Funding is available through local, state and federal revenues received by DHHS - Social Services.  As a result, approval of the attached software license and support services agreement will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations and enforcing laws and regulations to protect residents.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board may choose not to approve the attached software license and support services agreement with Biometrics4ALL regarding the provision, support and maintenance of a California Department of Justice approved electronic finger printing system.  However, this alternative is not recommended as it would severely limit DHHS - Social Services’ ability to perform background checks that are necessary to protect clients, families and employees.
