RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Find that the public health, safety, and well-being require a five (5) year extension of the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc.;
2. Approve, and authorize the Chair of the Board to execute, the attached tenth amendment to the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc.;
3. Approve, and authorize the Chair of the Board to execute, the attached twelfth amendment to the southern solid waste container site operation agreement with Recology Eel River;
4. Approve, and authorize the Chair of the Board to execute, the attached eleventh amendment to the Redway Transfer Station operation and maintenance agreement with Recology Eel River; and
5. Direct the Clerk of the Board to return one (1) fully executed original copy of each attached amendment to the Department of Public Works for further processing.

DISCUSSION:
The reimbursement rates for the solid waste container sites and transfer station located in Humboldt County are calculated each year by adding the annual index-based adjustments, as set forth in the County of Humboldt’s solid waste container site and transfer station agreements, plus any changes in the operators’ disposal, processing and operation costs. The reimbursement rate adjustments for the solid waste container sites and transfer station located in Humboldt County for fiscal year 2021-2022 are as follows:
• Humboldt Sanitation Company, Inc. - Northern Solid Waste Container Sites: Reimbursement rate adjustment will result in an increase of Seven Hundred Thirty-Nine Dollars and Forty-One Cents ($739.41), or less than four percent (4%), from the prior year’s reimbursement of Twenty-One Thousand Seven Hundred Twenty-Eight Dollars and Fifty-Two Cents ($21,728.52).
• Recology Eel River - Southern Solid Waste Container Sites: Reimbursement rate adjustment will result in an increase of Eight Hundred Six Dollars and Forty Cents ($806.40), or less than eight percent (8%), from the prior year’s reimbursement of Ten Thousand Nine Hundred Ninety-Four Dollars and Forty-Two Cents ($10,994.42).
• Recology Eel River - Redway Transfer Station: Reimbursement rate adjustment will result in an increase of One Thousand Seven Hundred Forty-One Dollars and Ninety-Nine Cents ($1,741.99), or less than twelve percent (12%), from the prior year’s reimbursement of Fourteen Thousand Nine Hundred Thirty-Seven Dollars and Seventy-Five Cents ($14,937.75).
The attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation Company, Inc. and Recology Eel River will effectuate the above-referenced reimbursement rate adjustments as of July 1, 2021. It should be noted that the attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation Company, Inc. and Recology Eel River are coming to the Board after the effective date of the reimbursement rate adjustments set forth therein due to inadvertent delays that were caused by the COVID-19 pandemic.
In addition, the attached tenth amendment to the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc. will extend the term thereof for an additional five (5) years to December 31, 2026. Section 521-6(c) of the Humboldt County Code provides that agreements for the collection of solid waste or source-separated materials may be extended or renewed for additional terms of up to five (5) years, without a public hearing, if the Board of Supervisors determines that the public health, safety and well-being require such an extension or renewal. The proposed extension of the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc. will protect public health by ensuring that residential, commercial and industrial solid wastes are stored, transported, transferred, processed and disposed of in a safe, sanitary and environmentally acceptable manner. Unsanitary conditions resulting from an accumulation of solid waste can cause epidemic outbreaks, diseases, intolerable odors and waterborne diseases.
Accordingly, the Department of Public Works recommends that the Board approve, and authorize the Chair of the Board to execute, the attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation Company, Inc. and Recology Eel River.
FINANCIAL IMPACT:
The costs associated with the operation and maintenance of the solid waste container sites and transfer station located in Humboldt County, including, without limitation, recycling and illegal dumping clean-up, is projected to be approximately Six Hundred One Thousand Seven Hundred Six Dollars ($601,706) for fiscal year 2021-2022. Expenditure appropriations related to the attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation Company, Inc. and Recology Eel River have been included in the approved fiscal year 2021-22 budget for Public Works - Solid Waste Disposal budget unit 1100-438. As a result, approval of the attached amendments to the solid waste container site and transfer station agreements with Humboldt Sanitation Company, Inc. and Recology Eel River will not impact the Humboldt County General Fund.

The recommended actions support the Board of Supervisors’ Strategic Framework by providing community-appropriate levels of service.
