DISCUSSION:

 

Executive Summary

 

On March 4, 2021 an appeal of the Humboldt County Planning Commission’s February 18, 2021 approval of the Rising Goat Limited Special Permit application for a commercial cannabis operation was filed by Sue Jacobson, on behalf of the Water Rights Holders of the Overland Subdivision. This appeal was noticed and placed on the April 6, 2021 Board of Supervisors Agenda. A few hours prior to the scheduled hearing, the county received word that the two parties were in discussions and wished to have additional time to resolve the outstanding concerns related to the appeal. The Board of Supervisors opened the public hearing, advised the public of the request for continuance, and took public comment. At the end of the public comment period the matter was continued to the April 20, 2021 Board of Supervisors agenda.

 

On Thursday April 8, 2021 the applicant and appellant met with county staff to discuss the concerns and appeal issues. This resulted in county staff sending a letter on April 12, 2021 to the appellant clarifying how the conditions of approval would be implemented. On April 14, 2021 the appellant sent an email to the Clerk of the Board stating that their concerns had been addressed and that they were withdrawing the appeal.  No further action is needed by the Board of Supervisors on this matter.

 

 

 

FINANCIAL IMPACT:

There will be no additional effect on the General Fund. The appeal was withdrawn.
