DISCUSSION:
On December 3, 2020 the Planning Commission held a public hearing to consider the application the Lost Boys Farms, LLC Conditional Use Permit. The Planning Commission heard the staff report and public testimony from neighbors and neighborhood stakeholders contending that the required findings for protection of public welfare within the Carlotta/Hydesville Community Planning Area could not be made. At the hearing the Planning Commission also heard from the applicant and various industry stakeholders, arguing that the proposed measures satisfied all requirements of the code. Consistent with the recommendation of staff, the Planning Commission denied the project.

On December 15, 2020 Jeffrey Slack of Janssen Malloy LLP filed an appeal on behalf of Lost Boys Farms, LLC, challenging the Planning Commission denial of the project. On January 21, 2021 the managing member of Lost Boys Farms, LLC submitted a letter withdrawing the appeal. This letter was received by the Planning Division after the appeal hearing date of February 2, 2021 had been noticed. Therefore, this brief report is simply to notify the public and the Board of Supervisors that this appeal has been withdrawn and the action of the Planning Commission to deny the permit is the official action.
