RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Accept the completed contract, including the change order approved by the Public Works Department, between Mobley Construction dba MCI, and Humboldt County for construction of Williams Creek Emergency Streambank Repair Project; and

2.                     Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $306.57, which will bring the total amount paid to 100 percent of the contract.

DISCUSSION:

The Governor of the State of California declared a disaster for Humboldt County due to severe winter storms that occurred during the period of Feb. 24, 2019, through March 1, 2019. Due to the flooding associated with this declared disaster, the streambank of Williams Creek near Ferndale suffered scour and erosion resulting in the failure of an earthen berm on privately owned property and discharge of sediment-heavy floodwaters onto Ambrosini Lane, a county-maintained road, and adjacent property. The private landowner performed limited repairs to the berm during the summer of 2019; however, the berm continued to be unreinforced and vulnerable to further erosion.

 

Due to the imminent threat of further flooding, road closures and property damage, the Humboldt County Department of Public Works (“Public Works”) evaluated options to reduce impacts to Ambrosini Lane within the criteria that a project would not transfer flooding impacts to a new location and would not conflict with the ongoing Salt River Ecosystem Restoration Project led by the Humboldt County Resource Conservation District. A technical memorandum was completed in June 2019, identifying potentially feasible design options. Agreement was reached with the private landowner on the preferred option, and a temporary construction easement was executed. In June 2019, Public Works submitted a letter to the United States Department of Agriculture - Natural Resources Conservation Service (“NRCS”) requesting that NRCS develop a damage survey report and evaluate the project for funding eligibility under the Emergency Watershed Protection program.

 

On May 14, 2020, Public Works received funding approval from NRCS to proceed with the Williams Creek Emergency Streambank Repair Project. Public Works prepared plans and specifications for stabilizing approximately three hundred (300) feet of streambank with rock slope protection and a sheet pile wall, along with water management and erosion control measures.

 

On June 9, 2020, the Humboldt County Board of Supervisors authorized the Clerk of the Board to advertise the Williams Creek Emergency Streambank Repair Project for bids. On July 7, 2020, the county received six (6) bids for the project. The project agreement was awarded to Mobley Construction dba MCI, the lowest responsible bidder, on July 28, 2020. The award amount was Three Hundred Twenty-One Thousand Five Hundred Seventy-Four Dollars ($321,574), and the contract change order executed during the project did not change the authorized amount.  The contractor has completed the work in accordance with the plans and specifications, and NRCS has issued project approval.

 

Public Works recommends that the Board of Supervisors accept the completed contract, including the change order approved by Public Works for this project, and approve the final claim for payment.

 

FINANCIAL IMPACT:

Total construction costs for this project are Three Hundred Twenty-One Thousand Five Hundred Seventy-Four Dollars ($321,574). Progress payments totaling Three Hundred Twenty-One Thousand Two Hundred Sixty-Seven Dollars and Forty-Three Cents ($321,267.43) have been paid, and the final claim for payment in the amount of Three Hundred Six Dollars and Fifty-Seven Cents ($306.57) is outstanding.

 

Project construction was funded by the United States Department of Agriculture - Natural Resources Conservation Service (75%), California Governor’s Office of Emergency Services (18.75%), and the Humboldt County Road Fund (6.25%). The Road Fund portion of the construction costs was included in the fiscal year (FY) 2020-21 Road Fund Budget (1200331); therefore, the proposed actions have no impact on the Humboldt County General Fund.  The General Fund provided funding of approximately Seventy-Five Thousand Five Hundred Dollars ($75,500) for design and permitting through the Water Management budget (1100251) in FY 2019-20.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to accept the project. However, staff does not recommend this alternative because the project has been completed, and the requested Board actions are needed to accept the contract.
