RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached amendments to the solid waste collection franchise agreements with Recology Humboldt County, Recology Eel River, and Humboldt Sanitation Company, Inc.;
2. Approve, and authorize the Chair of the Board to execute, the attached tenth amendment to the Redway Transfer Station operation and maintenance agreement with Recology Eel River;
3. Approve, and authorize the Chair of the Board to execute, the attached eleventh amendment to the southern solid waste container site operation agreement with Recology Eel River;
4. Approve, and authorize the Chair of the Board to execute, the attached ninth amendment to the northern solid waste container site operation and hauling agreement with Humboldt Sanitation Company, Inc.; and
5. Direct the Clerk of the Board to return one (1) fully executed original copy of each attached amendment to the Department of Public Works for further processing.

DISCUSSION:
Section 521-8(b) of the Humboldt County Code provides that rate changes which occur as a result of annual index-based adjustments, changes in the franchise fee and/or the recycling percentage and changes in disposal and/or processing costs set forth in a solid waste collection franchise agreement may be implemented without action of the Board of Supervisors, if authorized by the franchise agreement, when the total annual rate increase does not exceed 8%. Such rate changes may be implemented by amendment to the franchise agreement executed by the Franchise Contract Administrator. All other rate changes shall be approved by the Board of Supervisors, after the holding of a public hearing.
All the rate adjustments set forth in the attached franchise amendments fall below the 8% threshold. The rate adjustments for the standard weekly residential 30-gallon pick-up service set forth in the County of Humboldt’s solid waste collection franchise agreements are as follows:
• Recolgy Humboldt County - Blue Lake / Fieldbrook, Unincorporated Arcata Area: Fee adjustment will increase the rate by $0.71 from $36.32 per month to $37.03 per month or less than 2%. This adjustment includes Recology Humboldt County’s cost to provide two (2) 18-cubic yard bins for community clean-up activities during the course of the fiscal year.
• Recology of Humboldt County - Unincorporated Eureka Area: Fee adjustment will increase the rate by $.77 from $39.42 per month to $40.19 per month or less than 2%.
• Tom's Trash - Willow Creek Area: Fee adjustment will increase the rate by $0.15 from $27.78 per month to $27.93 per month or less than 1%.
• Recology Eel River - Garberville, Holmes, Fortuna, Ferndale, Weott/Mvers Flat: Fee adjustment will increase the rate by $1.09 from $32.56 per month to $33.65 per month or less than 4%.
• Humboldt Sanitation Company. Inc. - Northwestern Area of Humboldt County: Fee adjustment will decrease the rate by $0.25 from $28.85 per month to $29.10 per month or less than 1%.
The reimbursement rates for the Redway Transfer Station and the solid waste container sites located in Humboldt County are calculated each year by adding the annual index-based adjustments, as set forth in the County of Humboldt’s solid waste container site and solid waste transfer station agreements, plus any changes in the operators’ disposal, processing and operation costs. The reimbursement rate adjustments for the Redway Transfer Station and the solid waste container sites located in Humboldt County are as follows:
• Recology Eel River - Redway Transfer Station: Reimbursement rate adjustment will result in an increase of $1,586.02 or 11.88% from the prior year’s reimbursement of $13,351.73.
• Recology Eel River - Southern Sold Waste Container Sites: Reimbursement rate adjustment will result in an increase of $167.12 or less than 2% from the prior year’s reimbursement of $10,020.90.
• Humboldt Sanitation Company, Inc. - Northern Solid Waste Container Sites: Reimbursement rate adjustment will result in an increase of $1,095.90 or less than 6% from the prior year’s reimbursement of $20.632.62.
Humboldt Waste Management Authority ("HWMA") is currently under contract with the County of Humboldt to handle the submittal of data pertaining to the disposal and handling of solid waste and recyclable materials to the California Department of Resources Recycling and Recovery. HWMA is retaining its current disposal fee rate of $129.01 per ton.
In addition to the fee changes outlined below, the attached amendments to the County of Humboldt’s solid waste collection franchise, solid waste container site and solid waste transfer station agreements include the addition of language to allow the option for amendments thereto to be executed with either manual or electronic signatures in accordance with any and all applicable local, state and federal laws, regulations and standards. It should be noted that the attached amendments are coming to the Board after the start date thereof due to in advertent delays that were caused by the COVID-19 pandemic.
FINANCIAL IMPACT:
Reimbursement for the operation and maintenance of the Redway Transfer Station and solid waste container sites located in Humboldt County, including recycling and illegal dumping clean-up, is projected at $562,252 for fiscal year 2020-21. Funds to cover these reimbursement costs have been incorporated in the approved fiscal year 2020-21 budget. As a result, approval of the attached amendments will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by providing community-appropriate levels of service.
