RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Appoint Dan Thomas to fill the vacancy on the Garberville Sanitary District governing board for the remaining two years, ending the first Friday of December 2020.

DISCUSSION:

Governing board member, Richard Thompson, resigned from the Garberville Sanitary District on October 22, 2019. Pursuant to Government Code, Section 1780 (d)(1), Garberville Sanitary District posted notice of the vacancy in three conspicuous places in the district for 15 days. Government Code, Section 61040, requires government board members to be registered voters and reside within the district boundary. The Garberville Sanitary District did not receive any interest for the position from registered voters who reside in the district.

 

Garberville Sanitary District did receive interest from Dan Thomas. Mr. Thomas lives just outside of the district boundary but votes, conducts business, and socializes within the Garberville Sanitary District. Dan has an interest in community service and, as a retired engineer with the California Department of Transportation (Caltrans), has a wealth of knowledge that will benefit the governing board in making decisions.

 

Pursuant to Government Code, Section 1780 (f)(1), when a vacancy is not filled by the district board by appointment, the board of supervisors of the county may appoint a person to fill the vacancy within 90 days of the date of the vacancy. Government Code, Section 24001, authorizes the board of supervisors to waive Government Code, Section 61040, for an appointed district office when it finds that the best interests of the district will be served. Garberville Sanitary District believes Dan Thomas would make a great addition to the governing board and requests your board appoint Mr. Thomas to fill the vacancy.

This appointment will not have an impact on the General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

Your board could choose not to make this appointment to the Garberville Sanitary District and instead choose to call an election to fill the vacancy. This option is not recommended as no registered voters in the district have applied for the office and it would create an undue financial hardship on the district.
