RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve Agreement Number 2020-16 (Attachment 1) between the Humboldt County Sheriff's Office (HCSO) and the Drug Enforcement Administration (DEA) of the United States Department of Justice;

2.                     Authorize the Chair of the Board, Sheriff, Undersheriff or Deputy Director Sheriff’s Administration to sign Agreement Number 2020-16 (Attachment 1) and to execute all necessary contracts and agreements and amendments thereto, in the name of the County of Humboldt, and all other certifications, assurances, or documents required by the Department of Justice for this grant program; and

3.                     Approve the supplemental budget (Attachment 2) for Sheriff Operations Domestic Cannabis Eradication/Suppression Program Grant (DCESP) budget unit 1100-221931 (4/5 vote required).

DISCUSSION:

Each year the DEA makes funding available to reimburse agencies for certain expenditures related to the eradication of marijuana in local jurisdictions. HCSO has received notice of approval for $406,000 for the period of Oct. 1, 2019 to Sept. 30, 2020.  This is an increase of $181,000 from last year’s grant. 

 

The funds will be spent for overtime of deputies or officers directly engaged in the cannabis eradication process, as well as some direct costs associated with the eradication and/or arrest of controlled substance violators. Examples of direct costs utilized by HCSO in the past include rental of aircraft, fuel for aircraft, and minor repairs and maintenance to support cannabis eradication.  This grant year HCSO will be able to purchase a skid steer tractor and trailer. HCSO attempted to purchase the tractor and trailer with last year’s grant funds, but unfortunately due to changes with DEA grant management, this purchase was not successful.

 

FINANCIAL IMPACT:

The supplemental budget request (attachment 2) recognizes $406,000 of grant revenue.  These grant funds are provided for specified activities directly related to marijuana eradication and controlled substance investigation and arrest. Any unused funds will be retained by the federal government at the end of the term. Acceptance of this agreement will have no impact on the county's General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could deny the request to accept DEA funds however, this is not recommended as these funds are integral to continuance of the county's marijuana control programs. In order to continue these programs without interruption the department would have to seek funding elsewhere or request additional monies from the general fund to cover overtime and other direct costs associated with the eradication program
