RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Waive the requirements of the Humboldt County Nuclear Free Ordinance with regard to the attached mental health performance agreement with the California Department of Health Care Services;

2.                     Approve, and authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute, the attached mental health performance agreement with the California Department of Health Care Services regarding the provision of community mental health treatment services to eligible Humboldt County residents for the period of July 1, 2018 through June 30, 2021;

3.                     Authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute all future amendments to the attached mental health performance agreement with the California Department of Health Care Services after review and approval by County Counsel, Risk Management and the County Administrative Office; and

4.                     Direct the Clerk of the Board to route two (2) certified copies of this Board order to the Department of Health and Human Services - Contract Unit for submission to the California Department of Health Care Services for final execution.

DISCUSSION:

The California Department of Health Care Services (“DHCS”) administers the Mental Health Services Act, Lanterman-Petris-Short Act, Projects for Assistance in Transition from Homelessness, Community Mental Health Services Block Grant and Crisis Counseling Assistance and Training programs, and oversees the provision of community mental health treatment services pursuant to the Bronzan-McCorquodale Act.

 

The attached mental health performance agreement with DHCS sets forth conditions, program principles and general requirements that the County of Humboldt must meet in order to receive critical state and federal funding for the provision of community mental health treatment services.  The attached mental health performance agreement with DHCS also includes a waiver from the State of California’s policy regarding the provision of separate psychiatric treatment for minors.  The Humboldt County Department of Health and Human Services - Mental Health (“DHHS - Mental Health”) initially requested the wavier for juvenile hospitalization at the County of Humboldt’s inpatient psychiatric health facility and crisis stabilization unit during fiscal year 2013-2014.  DHCS approved DHHS - Mental Health’s request for a juvenile hospitalization waiver on June 3, 2014.  This waiver is valid until rescinded by DHCS.

 

On September 17, 2019, DHSC sent DHHS - Mental Health the attached mental health performance agreement for review and execution.  DHCS requested that DHHS - Mental Health return executed copies of the attached mental health performance agreement by November 20, 2019.  On October 17, 2019, the Humboldt County Behavioral Health Board reviewed the attached mental health performance agreement with DHCS in accordance with California Welfare and Institutions Code Section 5604.2.  It should be noted that the attached mental health performance agreement with DHCS comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract preparation process.

 

Accordingly, DHHS - Mental Health recommends that the Board approve, and authorize the DHHS - Mental Health Director, or a designee thereof, to execute, the attached mental health performance agreement with DHCS regarding the provision of community mental health treatment services to eligible Humboldt County residents for the period of July 1, 2018 through June 30, 2021.  It is also recommended that the Board authorize the DHHS - Mental Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached mental health performance agreement with DHCS, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed community mental health treatment services.

 

FINANCIAL IMPACT:

Although the attached mental health performance agreement with DHCS indicates a zero maximum dollar value, funding for the County of Humboldt’s mental health programs is dependent on the execution thereof.  DHHS - Mental Health must meet the conditions and requirements set forth in Sections 5650(a) and 5847 of the California Welfare and Institutions Code and Section 3310 of Title 9 of the California Code of Regulations to receive state and federal funding administered by DHCS. 

 

Mental health program funding related to the attached mental health performance agreement with DHCS has been included in the approved fiscal year 2018-2019 and 2019-2020 budgets for DHHS - Mental Health Administration budget unit 1170-424.  As a result, approval of the attached mental health performance agreement with DHCS will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, improving the safety and health of our communities and providing community appropriate levels of services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the attached mental health performance agreement with DHCS regarding the provision of community mental health treatment services to eligible Humboldt County residents.  However, this alternative is not recommended since it would cause DHHS - Mental Health to lose critical funding for the provision of community mental health treatment services to high-need individuals who have a mental health diagnosis or a mental health diagnosis with a co-occurring substance use disorder.
