RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Find that the grant of a permanent easement for public utilities over the Sheriff's Wood Lot (SWAP Yard) is in the public interest and that the easement will not substantially conflict or interfere with the county's use of the property per Government Code Section 25526.6;
2. Execute the attached easement deed to City of Eureka in the presence of a notary public (Attachment 1); and
3. Direct the Clerk of the Board to transmit the executed deed to the Land Use Division for further processing.

DISCUSSION:
On April 26, 2016, The Board of Supervisors approved a "Public Works Agreement Between City of Eureka and County of Humboldt for a New Sewer Connection to the New Juvenile Hall Facility." (Attachment 2) In this agreement, the County of Humboldt agreed to dedicate a utility easement to City of Eureka for "sewer utility purposes necessary for maintenance of the existing sewer line that will be accepted into the city's system and/or the installation of a new or reconditioned sewer line and appurtenances through the county-owned parcels identified as Assessor Parcel Numbers 013-101-006 and 013-111-003."

Conveyance of this utility easement to City of Eureka completes county obligations resulting from this agreement.

FINANCIAL IMPACT:
A Forty-Five Thousand Dollar ($45,000) payment to the City of Eureka to cover connection fees, installation and maintenance related to the transfer of the sewer facilities into the city-maintained system was approved at the Board of Supervisors meeting on April 26, 2016. Payment was subsequently made to City of Eureka. There are no other costs or fees associated with this agenda item. There is no impact to the General Fund.
