RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Grant a waiver of the Nuclear Free Ordinance;
2. Authorize the Chair of the Board to sign and execute the attached Rental Agreement in triplicate with the Humboldt Bay Harbor, Recreation, and Conservation District; and
3. Direct the Clerk of the Board to return the executed Rental Agreement to Public Works - Real Property Division for transmittal.

DISCUSSION:
The Humboldt County Sheriff's Department's Boating Unit has kept a boat at the Woodley Island Marina since 2015. The Boating Safety Program is responsible for activities such as enforcement of state and local boating regulations, inspection of vessels, as well as search and rescue operations. The Marina is operated by the Humboldt Bay Harbor, Recreation, and Conservation District. The Sheriff's Department is requesting approval to renew the rental of their slip. Rent has been paid one year in advance. The rental sum total for the year is Three Thousand Thirty Dollars ($3,030). As stated in the Humboldt Bay Harbor, Recreation, and Conservation District's Rental Agreement, "payment of advance monthly payments shall remain at all times a month to month tenancy."

A waiver of the Nuclear Free Ordinance is requested because the Boating Unit has decided to use the Marina's standard slip rental agreement, which does not contain the Nuclear Free Ordinance language.

FINANCIAL IMPACT:
The rental sum of Two Hundred Fifty-Two Dollars and Fifty Cents ($252.50) per month, in which the Sheriff's Department shall pay twelve (12) months in advance for a total of Three Thousand Thirty Dollars ($3,030) will be paid with funds from the Boating Safety and Enforcement Financial Aid Program in the Sheriff's Boating Safety budget unit ...
