RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve, and authorize the Chair of the Board to execute, the attached first amendment to the Amended Planning Agreement to Undertake Feasibility Study of a Potential Licensing Proposal for the Potter Valley Project with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency;

2.                     Authorize the Chair of the Board to execute any and all subsequent amendments to the Amended Planning Agreement to Undertake Feasibility Study of a Potential Licensing Proposal for the Potter Valley Project with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency after review and approval by County Counsel and the County Administrative Office; and

3.                     Direct the Clerk of the Board to return one (1) fully executed original copy of the attached first amendment to the Amended Planning Agreement to Undertake Feasibility Study of a Potential Licensing Proposal for the Potter Valley Project with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency to Public Works - Environmental Services for further processing.

DISCUSSION:

On June 18, 2019 (Item C-20), the Humboldt County Board of Supervisors approved, and authorized the execution of, the Amended Planning Agreement to Undertake Feasibility Study of a Potential Licensing Proposal for the Potter Valley Project (“Amended Planning Agreement”) with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency.  The attached first amendment to the Amended Planning Agreement will add the Round Valley Indian Tribes as a party thereto.

 

Accordingly, staff recommends that the Board approve, and authorize the Chair of the Board to execute, the attached first amendment to the Amended Planning Agreement with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency.  It is also recommended that the Board authorize the Chair of the Board to execute any and all subsequent amendments to the Amended Planning Agreement, after review and approval by County Counsel and the County Administrative Office, in order to avoid any unnecessary delays in the development of a potential licensing proposal for the Potter Valley Project.

 

FINANCIAL IMPACT:

There are no costs associated with the attached first amendment to the Amended Planning Agreement with California Trout, Inc., Mendocino County Inland Water and Power Commission and Sonoma County Water Agency.  As a result, approval of the attached first amendment to the Amended Planning Agreement will not impact the Humboldt County General Fund.

The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure and creating opportunities for improved safety and health.
