RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Receive and file the bid proposals received for the Mitchell Road Storm Damage Project;

2.                     Award the Mitchell Road Storm Damage Project to McCullough Construction, Inc., for the total amount of $1,590,265;

3.                     Approve, and authorize the Chair of the Board to execute, the attached construction agreement upon submittal of the appropriate bonds and insurance; and

4.                     Direct the Auditor-Controller to establish a new object code 1200321-0336 Mitchell Road Storm Damage PM 1.15 and transfer $300,000 from 1200321-2118 to the new object code per the attached appropriation transfer.

DISCUSSION:

On Feb. 19, 2019, the Board of Supervisors authorized the Clerk of the Board to advertise the Mitchell Road Storm Damage Project for bids. On March 26, 2019, the county received five bids for the project, which are attached hereto as Attachment 1.

 

The engineering study performed for this location determined that the repair option initially proposed by the county and approved by the Federal Emergency Management Agency (FEMA) was not a feasible solution due to the significant footprint required to construct the mechanically stabilized embankment (MSE) wall. Excavation for the MSE wall would require full closure of Mitchell Road, and no detour route exists or could be reasonably constructed. Therefore, the project was designed as a soldier pile wall, which will restore the site to pre-disaster function and capacity with a minimal environmental impact and limited right-of-way acquisition.

 

The Department of Public Works submitted a request to FEMA for the increase in funding required for the soldier pile wall and received approval of the cost increase a few days after the bid proposals for the project were publicly opened. On April 16, 2019, Public Works received notification from FEMA that further review was required by the Office of Environmental and Historic Preservation due to the change in project scope. The environmental review has been completed, and the FEMA funding is approved for the soldier pile wall.

 

The county could not award the contract within the thirty-day award period specified in Section 3-1.04 of the contract due to cancellation of the Board of Supervisors meeting on April 23, 2019, and the additional environmental review required by FEMA. Public Works requested an extension of the award period from the first and second bidders. The first bidder declined this request; therefore, Public Works is recommending that the contract be awarded to the second bidder, who did agree to extend the award period.

 

Accordingly, the Department of Public Works recommends that the Board of Supervisors receive and file the bid proposals received for the Mitchell Road Storm Damage Project; award the Mitchell Road Storm Damage Project to McCullough Construction, Inc. for the total amount of $1,590,265; authorize execution of the attached construction agreement upon submittal of the appropriate bonds and insurance; and establish a new object code 1200321-0336 Mitchell Road Storm Damage PM 1.15 and transfer $300,000 from 1200321-2118 to the new object code per the attached appropriation transfer.

 

FINANCIAL IMPACT:

The Mitchell Road Storm Damage Project is being funded by Federal Emergency Management Agency Disaster funds (75 percent), California Office of Emergency Services funds (18.75 percent) and the Humboldt County Road Fund (6.25 percent).  The engineer’s cost estimate for the construction contract is $1,335,104. Total project cost is estimated at $1,965,265. Due to time constraints, only $300,000 is expected to be expended from the approved fiscal year 2018-2019 budget line 1200321-2118 Professional & Special Services. The remaining $1,665,265 in construction costs will be included in the proposed fiscal year 2019-2020 budget for Road Fund budget unit 1200321-0336 Mitchell Road Storm Damage PM 1.15. As a result, the Mitchell Road Storm Damage Project will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board of Supervisors may choose not to award the Mitchell Road Storm Damage Project to McCullough Construction, Inc.  However, this alternative is not recommended because the project will reconstruct the failed roadway using funds that would not otherwise be available to the county.
