RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve and authorize the Chair to sign four copies of the Exhibit A Cooperative Law Enforcement Annual Patrol Operating and Financial Plan, #16-LE-11051360-027 (Patrol Operating and Financial Plan), Modification 010, (Attachment 1) between Humboldt County Sheriff’s Office (HCSO) and United States Department of Agriculture, Forest Service, Six Rivers National Forest (USDA Forest Service) executed on Oct. 27, 2015 for the period beginning Oct. 1, 2018 and ending Sept. 30, 2019;

2.                     Approve and authorize the Chair to sign four copies of the Exhibit B Cooperative Law Enforcement Annual Controlled Substance Operations and Financial Plan #16-LE-11051360-027 (Controlled Substance Operating and Financial Plan), Modification 011, (Attachment 2) between Humboldt County Sheriff’s Office (HCSO) and United States Department of Agriculture, Forest Service, Six Rivers National Forest (USDA Forest Service) executed on Oct. 27, 2015 for the period beginning Oct. 1, 2018 and ending Sept. 30, 2019;

3.                     Authorize the Sheriff, Undersheriff and Deputy Director Sheriff’s Administration to execute all the necessary reimbursement claims, applications, contracts, and agreements and amendments thereto, in the name of the County of Humboldt, and all other documents required by the USDA Forest Service Six Rivers National Forest; and

4.                     Direct the Clerk of the Board to return signed copies of the agreement to the HCSO, Attention: Manda Terrill for submittal to funding agency.

DISCUSSION:

The USDA Forest Service makes funds available via Six Rivers National Forest through a 5-year Cooperative Law Enforcement Master Agreement for added law enforcement and drug operations services in Forest Service campgrounds and on roads maintained by the Forest Service. The current 5-year Master Cooperative Law Enforcement Agreement was approved by your Board on Oct. 13, 2015 for the period beginning October 1, 2015 through September 30, 2020. Modifications are signed each year for approval of annual financial plans, for both the Patrol Operating and Financial Plan (Attachment 1) and the Controlled Substance Operating and Financial Plan (Attachment 2). In the past annual financial modifications were brought to your Board for review, however, staff is recommending that you authorize the Chair and Sheriff to sign annual modifications for the duration of this agreement period.

 

The Cooperative Law Enforcement Master Agreement establishes a cooperative effort between the Sheriff and local Forest Service offices to enhance local law enforcement in connection with law enforcement activities on National Forest Service lands and provide for reimbursement to HCSO for services provided under this agreement.

 

FINANCIAL IMPACT:

The USDA Forest Service Cooperative Law Enforcement 5-year Master Agreement authorizes reimbursement for services provided to the Forest Service by the HCSO.  Reimbursement rates are negotiated each year with operating agreement modifications that begin Oct. 1 each year and expire Sept. 30 of the following year. Modifications 010 and 011 are detailed as follows:

This action supports your Board’s Strategic Framework by seeking outside funding sources to benefit Humboldt County needs .

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could deny approval of the Cooperative Law Enforcement annual operating and financial plans with USDA Forest Service; however, this is not recommended as it would leave the County without reimbursement for services performed on Federal lands.
