RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve Agreement Number 2019-18 (Attachment 1) between the Humboldt County Sheriff's Office (HCSO) and the Drug Enforcement Administration of the United States Department of Justice;

2.                     Authorize the Sheriff, Undersheriff or Deputy Director Sheriff’s Administration to sign Agreement Number 2019-18 (Attachment 1) and to execute all necessary contracts and agreements and amendments thereto, in the name of the County of Humboldt, and all other documents required by the Department of Justice for the grant program; and

3.                     Authorize the Sheriff, Undersheriff or Deputy Director Sheriff’s Administration to sign certifications (Attachment 2):

a.                     Request for Advance or Reimbursement

b.                     Certification Regarding Lobbying; Debarment, Suspension and Other Responsibility Matters, and Drug Free Workplace Requirement

DISCUSSION:

Each year the Drug Enforcement Administration (DEA) makes funding available to reimburse agencies for certain expenditures related to the eradication of marijuana in local jurisdictions. Announcement of awards was made on Feb. 21, 2019 and HCSO has received notice of approval for $225,000 for the period of Oct. 1, 2018 to Sept. 30, 2019. This shortened grant performance period will allow the Drug Enforcement Administration to coordinate future grant periods to coincide with the federal fiscal year.

 

Agreement 2019-18 (Attachment 1) specifies that the funds must be spent for overtime of deputies or officers directly engaged in the cannabis eradication process, as well as appropriate per diem and some direct costs associated with the eradication and/or arrest of controlled substance violators. Examples of direct costs utilized by HCSO in the past include rental of aircraft, fuel for aircraft, and minor repairs and maintenance to support cannabis eradication.

 

FINANCIAL IMPACT:

The Request for Advance or Reimbursement Form SF270 will be submitted with Agreement Number 2019-18 and other assurances, with a request for advance payment of $225,000. Revenue from this agreement will be deposited in budget unit 1100-228 Marijuana Eradication.

 

These grant funds are provided for specified activities directly related to marijuana eradication and controlled substance investigation and arrest. The agreement period is from Oct. 1, 2018 to Sept. 30, 2019 and claims are allowed retroactively to the beginning date of the agreement. Any unused, funds will be returned to the federal government at the end of the term. Acceptance of this agreement will have no impact on the county's General Fund.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could deny the request to accept DEA funds awarded in Agreement Number 2019-18 however, this is not recommended as these funds are integral to continuance of the county's marijuana control programs. In order to continue these programs without interruption the department would have to seek funding elsewhere or request additional monies from the general fund to cover overtime and other direct costs associated with the eradication program.
