RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute, the attached St. Joseph Health Information Exchange Clinical Viewer “ShareVue” Participation Agreement with St. Joseph Health System;
2. Waive the requirements of the Humboldt County Nuclear Free Ordinance with regard to the attached St. Joseph Health Information Exchange Clinical Viewer “ShareVue” Participation Agreement with St. Joseph Health System;
3. Authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute any and all future amendments to the attached St. Joseph Health Information Exchange Clinical Viewer “ShareVue” Participation Agreement with St. Joseph Health System, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
4. Authorize the Department of Health and Human Services Director, or a designee thereof, to execute agreements substantially similar to the attached St. Joseph Health Information Exchange Clinical Viewer “ShareVue” Participation Agreement with St. Joseph Health System, after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:
St. Joseph Health System’s electronic health record system “ShareVue” allows eligible healthcare providers and organizations to share access to electronic health information concerning patients with whom they share a treatment relationship, as mandated by federal health reform. The “ShareVue” electronic health record system manages and administers the “ShareVue” Link by acting as an interface between healthcare providers and organizations.
The attached St. Joseph Health Information Exchange Clinical Viewer “ShareVue” Participation Agreement (“Participation Agreement”) with St. Joseph Health System will provide Department of Health and Human Services - Mental Health (“DHHS - Mental Health”) personnel with secure “read only” access to electronic health records for those patients with whom the county and St. Joseph Hospital share a treatment relationship, in order to improve the delivery and coordination of care to those patients.
It should be noted that the attached Participation Agreement with St. Joseph Health System does not contain a fixed term and will expire only upon the termination thereof by either party. In addition, any and all disputes arising from the attached Participation Agreement must be litigated in Orange County rather than Humboldt County. Finally, staff recommends that the Board waive the requirements of the Humboldt County Nuclear Free Ordinance in order to approve the attached Participation Agreement, since it does not contain a provision which requires St. Joseph Health System to comply with the terms thereof.
For the reasons stated above, DHHS - Mental Health recommends that the Board approve, and authorize the DHHS - Mental Health Director, or a designee thereof, to execute, the attached Participation Agreement with St. Joseph Health System. DHHS - Mental Health also recommends that the Board authorize the DHHS - Mental Health Director, or a designee thereof, to execute any and all future amendments, and other agreements that are substantially similar, to the attached Participation Agreement with St. Joseph Health System, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid potential delays in the provision of needed mental health services.
FINANCIAL IMPACT:
There are no expenses associated with the county’s use of the “ShareVue” electronic health record system. As a result, approval of the attached Participation Agreement with St. Joseph Health System will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the attached Participation Agreement with St. Joseph Health System. However, this alternative is not recommended because it will hinder the process of providing quality coordinated health care to mutual clients.
