RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached first amendment to the professional services agreement between the Department of Health and Human Services - Child Welfare Services and Kevin Kelly, PhD regarding the performance of court-ordered competency and psychological evaluations for youth and adult clients for the period of Jan. 1, 2018 through June 30, 2019;
2. Authorize the Department of Health and Human Services Director, or a designee thereof, to execute any and all future amendments to the professional services agreement with Kevin Kelly, PhD, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return two fully executed original copies of the attached first amendment to the professional services agreement with Kevin Kelly, PhD to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
On April 24, 2018 (Item C-12), the Humboldt County Board of Supervisors approved the current professional services agreement between the Department of Health and Human Services - Child Welfare Services (DHHS - CWS) and Kevin Kelly, PhD regarding the performance of court-ordered competency and psychological evaluations for youth and adult clients. The attached first amendment to the professional services agreement with Kevin Kelly, PhD will increase the maximum amount payable thereunder in order to cover unexpected utilization of the competency and psychological evaluation services provided by Kevin Kelly, PhD.
Accordingly, DHHS - CWS recommends that the Board of Supervisors approve, and authorize the Chair of the Board to execute, the attached first amendment to the professional services agreement with Kevin Kelly, PhD regarding the performance of court-ordered competency and psychological evaluations for youth and adult clients. It is also recommended that the Board authorize the DHHS - CWS Director to execute any and all future amendments to the professional services agreement with Kevin Kelly, PhD, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to ensure the efficient delivery of necessary competency and psychological evaluation services.
FINANCIAL IMPACT:
The attached first amendment to the professional services agreement with Kevin Kelly, PhD will increase the maximum amount payable thereunder from $49,000 to $126,000 for the period of Jan. 1, 2018 through June 30, 2019. In no event shall the maximum amount paid under the professional services agreement with Kevin Kelly, PhD exceed $37,000 for fiscal year (FY) 2017-18 and $49,000 for FY 2018-19. However, if local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the professional services agreement with Kevin Kelly, PhD in its entirety.
Expenditure appropriations related to the attached first amendment to the professional services agreement with Kevin Kelly, PhD have been included in the approved fiscal year 2018-2019 budget for DHHS - Social Services budget unit 1160-508. As a result, approval of the attached first amendment to the professional services agreement with Kevin Kelly, PhD will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations and creating opportunities for improved safety and health.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the attached first amendment to the professional services agreement with Kevin Kelly, PhD regarding the performance of court-ordered competency and psychological evaluations for youth and adult clients. However, this alternative is not recommended since it would require DHHS - CWS to directly perform the court-ordered competency and psychological evaluations currently being performed by Kevin Kelly, PhD, which is not feasible at this time.
