RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive and file the bids for Accessibility upgrades at Clam Beach County Park Project Number 2017-204;
2. Award the project to the lowest responsible and responsive bidder, Adams Commercial General Contracting, Inc.; and
3. Authorize the Purchasing Agent to sign the construction agreement with Adams Commercial General Contracting, Inc. in the form of the attached sample agreement subject to approval from County Counsel and Risk Management.

DISCUSSION:
On October 16, 2017, the County of Humboldt entered into a consultant services agreement with The KPA Group to design ADA improvements at Clam Beach Park. The Consent Decree requires the county to perform barrier removal of the existing non-accessible vault toilet rooms at both the South campground and the North day-use facility. Both facilities currently do not have the square footage necessary to be ADA compliant. ADA modifications will entail demolition of the existing non-compliant and aging toilet facilities and the construction of brand new accessible vault toilet rooms at both locations. The project will include building of accessible routes interconnecting amenities such as trail heads, campsites, parking stalls and toilet rooms. Other ADA improvements include two accessible campsites with inclusive amenities such as fire rings, picnic tables and tent camping locations.
On November 6, 2018, Your Board authorized the Clam Beach Park Americans with Disabilities Act Project to be advertised for public bid. On January 8, 2019, the county received and opened one (1) responsive bid submitted by Adams Commercial General Contracting, Inc. and one (1) bid determined to be non-responsive submitted by McCullough Construction. The results are as follows:

Staff determined the bid submitted by McCullough Construction to be non-responsive due to the requirements set in the general conditions of the project specifications manual section 00 11 16 dictating that the successful bidder shall possess a valid Contractor’s license in good standing, with a classification of "B” (General Building Contractor). McCullough Construction has a class “A” license and does not have the required class “B” license.
The general conditions set forth in the project specifications manual require that the project be awarded on the merits of the lowest qualified, responsible and responsive base bid. Staff recommends that your Board award this project to Adams Commercial General Contracting, Inc. - Eureka, California for the total base bid award amount of $362,109.
FINANCIAL IMPACT:
The estimated cost for accessibility upgrades at Clam Beach was $890,534.70. The current project expenses combined with the Adams Commercial General Contracting Base Bid amount of $362,109, establishes a revised estimated project cost of $411,994, and is approximately $478,540 under project estimates. The ADA Compliance budget (3552-152) has sufficient funds for this project.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to approve the recommendations to award the project however, this is not recommended as the county may be subject to fines for non-compliance, as Clam Beach County Park is a facility identified by the DOJ with ADA barriers that must be removed prior to the termination of the consent decree.
