RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1. Approve, and authorize the Chair of the Board to execute, the attached second amendment to the memorandum of understanding (MOU) with Crestwood Behavioral Health, Inc. regarding the provision of emergency evacuation services for the period of June 1, 2012 through May 31, 2020;

2. Authorize the Department of Health and Human Services - Mental Health Director, or a designee thereof, to execute all future amendments to the memorandum of understanding with Crestwood Behavioral Health, Inc. regarding the provision of emergency evacuation services, after review and approval by County Counsel, Risk Management and the County Administrative Office; and

3. Direct the Clerk of the Board to return two (2) fully executed original copies of the attached second amendment to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:

The Centers for Medicare and Medicaid Services requires the Humboldt County Department of Health and Human Services - Mental Health (DHHS - Mental Health) to enter into a written agreement with a qualified institution, organization or agency regarding the evacuation of patients from the county’s psychiatric health facility in the event of an emergency which renders such facility inoperable or uninhabitable.

 

On June 26, 2012 (item C-12), the Board of Supervisors approved the current MOU with Crestwood Behavioral Health, Inc. (Crestwood) regarding the provision of emergency evacuation services for the period of June 1, 2012, through May 31, 2016. The Board subsequently approved the first amendment to the MOU with Crestwood, which extended the term thereof through May 31, 2020, and updated the contact list attached thereto, on April 26, 2016. Approval of the attached second amendment to the MOU with Crestwood will allow for the inclusion of a counterpart execution provision therein and once again update the contact list attached thereto.

 

Accordingly, DHHS - Mental Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached second amendment to the MOU with Crestwood regarding the provision of emergency evacuation services for the period of June 1, 2012 through May 31, 2020.  DHHS - Mental Health also recommends that the Board authorize the DHHS - Mental Health Director, or a designee thereof, to execute any and all subsequent amendments to the MOU with Crestwood, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid potential delays in the provision of needed emergency evacuation services. 

 

FINANCIAL IMPACT:

In the event of a fire, natural disaster or other emergency requiring evacuation of the county’s psychiatric health facility, the costs associated with evacuating and transporting patients to Crestwood’s facilities would be funded through bed day revenues received by DHHS - Mental Health. The costs associated with the care of DHHS - Mental Health clients placed at Crestwood’s facilities due to evacuation of the county’s psychiatric health facility would be covered under the county’s current placement services agreement with Crestwood.

 

Expenditure appropriations related to the attached second amendment to the MOU with Crestwood have been included in the approved fiscal year 2018-2019 budget for DHHS - Mental Health budget unit 1170-495. As a result, approval of the attached second amendment to the MOU with Crestwood will not impact the Humboldt County General Fund.

 

STRATEGIC FRAMEWORK:

The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations within Humboldt County and facilitating public/private partnerships to solve problems.

 

OTHER AGENCY INVOLVEMENT:

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the attached second amendment to the MOU with Crestwood regarding the provision of emergency evacuation services. However, this alternative is not recommended since it could result in delaying the evacuation of patients from the county’s psychiatric health facility in the event of an emergency which renders such facility inoperable or uninhabitable.
