RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive and approve the plans and specifications for A.W. Way Park Americans with Disabilities Act (ADA) Project; and
2. Authorize the Clerk of the Board to advertise the above-referenced project, pursuant to Section 22037 of the California Public Contract Code, with bids to be open on February 12, 2019.

DISCUSSION:
On September 7, 2016, the county entered into a Consent Decree with the United States Department of Justice (DOJ) that required the commencement of the Humboldt County Americans with Disabilities Act Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services and activities to the public into compliance with the ADA by September 07, 2019. The A.W. Way Park project is part of this compliance effort.
On June 5, 2018, the County of Humboldt entered into a consultant services agreement with The KPA Group to design ADA improvements at A.W. Way Park. The construction project will include ADA modifications as follows: providing one (1) accessible parking stall at the entry sign and fee station; providing two (2) accessible paved campsites with one (1) accessible parking stall at each campsite; replacing existing water spigot at entry sign with accessible drinking fountain; providing accessible paths of travel between (new) campsites, toilet rooms, (new) drinking fountain, and the fee/entry station.
The construction schedule is expected to be 60 calendar days and is anticipated to begin on March 4, 2019, and be completed by May 6, 2019, in time for the park’s summer recreation season.
FINANCIAL IMPACT:
The total cost of the A.W. Way Park project is estimated at $246,066 including design. The ADA Compliance budget unit (3552-152) has budgeted $100,000 in Fiscal Year (FY) 2018-19 for this project. Staff plan to come back to your Board at the time of project award with a supplemental budget for the balance of the project once bids are received and costs are known. The ADA Trust (4491) has sufficient funds for the balance of the project. The ADA Trust has a fund balance of approximately $2,164,083.
The item before you today supports your Boards’ strategic framework of fostering transparent, accessible, welcoming and user friendly services and enforces laws and regulations to protect residents.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to approve the recommendations to approve the plans and authorization to bid. However, the county may be subject to fines for non-compliance, as A.W. Way Park is a facility identified by the DOJ with ADA barriers that must be removed prior to the termination of the consent decree.
