RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Appoint Jeffrey Blanck to serve as an ex officio member of the Law Library Trustees at the request of the Chair of the Board of Supervisors; and

2.                     Appoint Maggie Fleming and Cyndy Day-Wilson to the Board of the Law Library Trustees.

DISCUSSION:

Pursuant to Sections 6300 et seq. of the California Business & Professions Code (B&P), each county in the state has a law library which is governed by a Board of Trustees.  That Board, under B&P § 6301, consists of both judges-elected by their peers on the Superior Court bench-and members appointed by the county Board of Supervisors.

 

One of the Trustee positions is specifically reserved for the Chair of the Board of Supervisors, as an ex officio member of the Board of Trustees.  However, the Chair may, under B&P § 6301 (a) (4), ask the Board of Supervisors to appoint someone else to serve in this position.  Since Jan. 5, 2016, County Counsel Jeffrey Blanck has served as the ex officio member in lieu of the Board Chair. Mr. Blanck has indicated his willingness to continue assuming this role.

 

The two Board appointees (excluding the ex officio member) can be any two members of the State Bar. Since Jan. 6, 2015, District Attorney Maggie Fleming has served as the Board’s appointee. Ms. Fleming has indicated her willingness to serve an additional term. In order to fill the remaining seat, staff recommends appointing attorney Cyndy Day-Wilson to that seat; Ms. Day-Wilson has served as a member since Jan. 6, 2015 and has indicated her willingness to continue serving.

 

Appointments by the Board of Supervisors are for one-year terms, and are to be made at the first meeting of the Board each January, pursuant to B&P § 6302.  Accordingly, staff asks that your Board appoint Mr. Blanck as the ex officio member in lieu of the Board Chair and Ms. Fleming and Ms. Day-Wilson as the two Board appointees.

 

FINANCIAL IMPACT:

The financial impact of staff serving the Law Library is already built in to departmental budgets, so there is no impact to the General Fund.

 

These recommendations serve your Board’s Strategic Framework by supporting self-reliance of citizens, creating opportunities for improved safety and health, and fostering transparent, accessible, welcoming and user-friendly services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

As noted, the Board could appoint any other members of the State Bar and the Board Chair could serve in the ex officio position.
