1.                     Approve and ratify the Public Works Director’s execution of the attached first amendment to the professional services agreement with Nichols, Melburg & Rossetto Architects regarding the provision of design engineering services for the Humboldt County Juvenile Hall Replacement Facility Construction Project.

DISCUSSION:

On December 11, 2012, the Board of Supervisors authorized the Public Works Director to advertise and distribute a Request for Qualifications for Professional Services for the design of the Humboldt County Juvenile Hall Replacement Facility Construction Project (“Juvenile Hall Replacement Project”).

 

On March 18, 2014, the Board authorized the Public Works Director to enter into negotiations with Nichols, Melburg & Rossetto Architects (“NMR”) for professional services to continue the design of the Juvenile Hall Replacement Project.  The Board subsequently authorized award of a professional services agreement to NMR for design engineering services on April 8, 2014.  The original professional services agreement with NMR had a maximum amount payable of One Million Two Hundred Sixty-Four Thousand Eight Hundred Ninety-Eight Dollars ($1,264,898) for a period of one thousand one hundred twenty-eight (1,128) days.

 

On June 27, 2017, the Board approved the current professional services agreement with NMR due to the project extending past the original contractual period of one thousand one hundred twenty-eight (1,128) days.  The current professional services agreement replaced the original professional services agreement with NMR and extended the term thereof through anticipated completion of the ongoing Juvenile Hall Replacement Facility Construction Project for a total of two thousand fifty-five (2,055) days.

 

For reasons beyond the county’s control, construction of the Juvenile Hall Replacement Project has been delayed beyond the originally anticipated completion date of October 8, 2018.  The attached first amendment to the current professional services agreement with NMR will extend the term thereof for an additional three hundred sixty-five (365) days in order to allow for the provision of design engineering services for the anticipated construction time beyond October 8, 2018.

 

Accordingly, staff recommends that the Board approve and ratify the Public Works Director’s execution of the attached first amendment to the current professional services agreement with NMR regarding the provision of design engineering services for the Juvenile Hall Replacement Project.

 

FINANCIAL IMPACT:

Approval of the attached first amendment to the current professional services agreement with NMR will increase the County of Humboldt’s existing financial obligation for the design engineering services provided by NMR by Two Hundred Seventy-Two Thousand Eight Hundred Seventy-Six Dollars ($272,876) for a total maximum amount payable of One Million Five Hundred Thirty-Seven Thousand Seven Hundred Seventy-Four Dollars ($1,537,774).  

 

Expenditure appropriations related to the attached first amendment to the current professional services agreement with NMR have been included in the approved fiscal year 2018-2019 budget for Capital Projects budget unit 1100-170-8891. 

 

The recommended actions conform to the Board of Supervisors’ Strategic Framework of providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board could choose not to approve, and ratify the Public Works Director’s execution of, the attached first amendment to the current professional services agreement with NMR regarding the provision of design engineering services for the Juvenile Hall Replacement Project.  This alternative is not recommended because it would delay and complicate the oversight of the ongoing Juvenile Hall Replacement Project.
