RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached first amendment to the agreement for consultant services with Ghirardelli Associates, Inc. regarding the provision of construction management services for the Williams Creek Bridge Replacement Project; and
2. Direct the Clerk of the Board to return two (2) fully executed original copies of the attached first amendment to the Department of Public Works for further processing.

DISCUSSION:
On January 3, 2017, the Humboldt County Department of Public Works issued a Request for Qualification (“RFQ”) for the purpose of creating a pool of qualified consultants who will be available to meet the department’s construction management needs. The RFQ was the first step of the two-step selection process set forth in Chapter 10 of the California Department of Transportation’s Local Assistance Procedures Manual. The Board of Supervisors subsequently approved the pool of qualified consultants on March 7, 2017.
On January 12, 2018, the department issued a Request for Proposals (“RFP”) regarding the provision of specific construction management services required for the Williams Creek Bridge Project to the pool of qualified consultants. The RFP contained a specific scope of services and solicited a cost proposal and performance schedule. The proposals submitted in response to the RFP for the project were evaluated and ranked by the selection committee. The highest ranking consultant was Ghirardelli Associates, Inc., and the final ranking of proposals was issued on March 1, 2018.
On May 15, 2018, the Board of Supervisors approved, and authorized the Chair of the Board to execute, the consultant services agreement with Ghirardelli Associates, Inc., regarding the provision of construction management services for the Williams Creek Bridge Replacement Project (Attachment 1). As part of such agreement, the County of Humboldt agreed to a maximum amount payable of Two Hundred Sixty Thousand Seven Hundred Thirty-Six Dollars and Thirty-Three Cents ($260,736.33). However, on November 6, 2018, Ghirardelli Associates, Inc. submitted a proposed cost increase of One Hundred Thirty-One Thousand Four Hundred Six Dollars and Ninety-Seven Cents ($131,406.97) (Attachment 2) in order to cover unexpected costs and expenses associated with ensuring conformance with project plans, material specifications and environmental permits.
The attached first amendment to the consultant services agreement with Ghirardelli Associates, Inc. will extend the term thereof to December 31, 2019, and increase the maximum amount payable thereunder to Three Hundred Ninety-Two Thousand One Hundred Forty-Three Dollars and Thirty Cents ($392,143.30), in order to allow for the provision of additional construction management services needed to complete the Williams Creek Bridge Replacement Project.
Accordingly, staff recommends that the Board of Supervisors approve, and authorize the Chair of the Board to execute, the attached first amendment to the consultant services agreement with Ghirardelli Associates regarding the provision of construction management services for the Williams Creek Bridge Replacement Project (Attachment 3).
FINANCIAL IMPACT:
As noted above, the attached first amendment to the consultant services agreement with Ghirardelli Associates, Inc. will increase the amount maximum amount payable thereunder by One Hundred Thirty-One Thousand Four Hundred Six Dollars and Ninety-Seven Cents ($131,406.97) to Three Hundred Ninety-Two Thousand One Hundred Forty-Three Dollars and Thirty Cents ($392,143.30) for the period of May 15, 2018 through December 31, 2019.
The construction management services provided pursuant to the terms and conditions of the consultant services agreement with Ghirardelli Associates, Inc. are 88.53 percent funded by the FHWA Highway Bridge Program and 11.47 percent funded by the Humboldt County Road Fund. Expenditure appropriations related to the attached first amendment to the consultant services agreement with Ghirardelli, Inc. have been included in the approved fiscal year 2018-2019 budget for Road Fund budget unit 1200321-2118. As a result, approval of the attached first amendment to the consultant services agreement with Ghirardelli Associates, Inc. will not impact the Humboldt County General Fund.
The recommended actions support the Board of Supervisors’ strategic framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose to not authorize the attached first amendment to the consultant services agreement with Ghirardelli Associates, Inc. regarding the provision of construction management services for the Williams Creek Bridge Replacement Project. However, this alternative is not recommended since the county has limited staff to manage the construction of the Williams Creek Bridge Replacement Project.
