RECOMMENDATION(S):

Recommendation

That the Board of Supervisors receive and approve the plans and specifications for the Clam Beach Park Americans with Disabilities Act (ADA) Project; authorize the Clerk of the Board to advertise the above-referenced project, pursuant to Section 22037 of the California Public Contract Code, with bids to be opened on January 8, 2019; and adopt the supplemental budget depicted below for the ADA Compliance budget unit (4/5 Vote Required).

DISCUSSION:

On September 7, 2016, the county entered into a Consent Decree with the United States Department of

Justice (DOJ) that required the commencement of the Humboldt County Americans with Disabilities Act (ADA) Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services and activities to the public into compliance with the Americans with Disabilities Act by September 13, 2019. The Clam Beach Park project is part of this compliance effort.

 

On October 16, 2017, the County of Humboldt entered into a consultant services agreement with The KPA Group to design ADA improvements at Clam Beach Park. The Consent Decree requires the county to perform barrier removal of the existing non-accessible vault toilet rooms at both the South campground and the North day-use facility.  Both facilities currently do not have the square footage necessary to be ADA compliant.  ADA modifications will entail demolition of the existing non-compliant and aging toilet facilities and the construction of brand new accessible vault toilet rooms at both locations.  The project will include building of accessible routes interconnecting amenities such as trail heads, campsites, parking stalls and toilet rooms.  Other ADA improvements include two accessible campsites with inclusive amenities such as fire rings, picnic tables and tent camping locations. 

 

This project required a coastal development permit application to be filed with the California Coastal Commission for which a full Coastal Development Permit De Minimis Waiver under Coastal Act Section 30624.7 has been granted during the Commission’s October 11, 2018, meeting.

 

Presently, there is a need to increase the project budget, as current engineer’s estimates are higher than previously anticipated for the project. The amount payable for project design and construction is estimated at Nine Hundred Forty Eight Thousand Nine Hundred Fourteen Dollars ($948,914). 

 

Staff recommends that your Board approve the plans and specifications for the Clam Beach Park ADA Project and adopt the supplemental budget for the ADA Compliance budget unit.

 

 

FINANCIAL IMPACT:

The total cost for the Clam Beach ADA Project is estimated at $948,914. In Fiscal Year 2017-18, the county paid $20,056 for design services and site preparation. The ADA Compliance budget (3552-152) included $600,000 in its Fiscal Year 2018-19 budget for the project. A supplemental budget is needed due to costs exceeding original cost estimates. Unanticipated costs total $328,858. The County Administrative Officer has approved use of 2016 Finance Plan funds for additional costs not previously anticipated for the completion of the Consent Decree barrier removal at Clam Beach.

 

The item before you today supports your Boards’ strategic framework of fostering transparent, accessible, welcoming and user friendly services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

Your Board could choose to not approve the plans and bid authorization and supplemental budget; however, the county may be subject to fines for non-compliance, as the Clam Beach Park project is identified by the DOJ in the Consent Decree with ADA barriers that must be removed prior to the termination of the consent decree.
