RECOMMENDATION(S):

Recommendation

That the Board of Supervisors receive and approve the plans and specifications for the Fortuna Veterans Hall Americans with Disabilities Act (ADA) Project; authorize the Clerk of the Board to advertise the above-referenced project, pursuant to Section 22037 of the California Public Contract Code, with bids to be opened on November 20, 2018; and adopt the supplemental budget depicted below for the ADA Compliance budget unit (4/5 Vote Required).

DISCUSSION:

On September 7, 2016, the county entered into a Consent Decree with the United States Department of

Justice (DOJ) that required the commencement of the Humboldt County Americans with Disabilities Act (ADA) Compliance Project. The purpose of the Humboldt County Americans with Disabilities Act Compliance Project is to bring all county-owned and leased facilities that provide programs, services and activities to the public into compliance with the Americans with Disabilities Act by September 13, 2019. The Fortuna Veterans Hall project is part of this compliance effort.

 

On November 14, 2017, the County of Humboldt entered into a consultant services agreement with Brokaw Design to design the first phase of ADA improvements at the Fortuna Veterans Hall as directed in the Consent Decree. The construction project includes an accessible path of travel from the public right-of-way to the building entrance, a van accessible parking stall, reconstruction of the ramp at the building entrance, installation of assisted opening devices at the accessible doors, a wheelchair lift at the stage located in the main hall, and the addition of a fully accessible unisex restroom.  Special attention and care to protect the facility’s historical and architectural finishes have been taken into consideration in all elements of the design.  County Administrative Office staff worked with Public Works and Brokaw Design in the review and development of the project’s plans and timeline.  Construction is estimated to take 120 calendar days to complete and is expected to begin in January 2019, and completed by May 2019.

 

On September 18, 2018, the County of Humboldt entered into a consultant services agreement with Brokaw design for the second phase of this project. ADA barriers in phase two of the project were not specifically called out in the Consent Decree but rather in the full assessment report of the Fortuna Veterans Hall and require barrier removal.  The second phase of this project ties into the flooring and electrical repairs budgeted in Public Works Capital Project budget (1100-170) where $50,000 has been established for roofing, flooring and electrical repairs at the Fortuna Veterans Hall. With the need to begin the flooring project in the lounge area ADA barrier removal identified in the full assessment must also be address at the same time. ADA compliance design in phase two will consist of a new lounge with both high and low seating, new interior finishes and new electrical outlets making the lounge area ADA compliant. Total design costs for this phase will total $19,300. $5,500 of the total design costs have been budgeted in the Public Works Capital Projects budget (1100-170). While the ADA Compliance budget is responsible for the remaining $13,800.

 

Presently, there is a need to increase the project budget, as current engineer’s estimates are higher than previously anticipated for phase one of the project. The amount payable for project design and construction is estimated at Three Hundred Fifty Nine Thousand Eight Hundred Five Dollars ($359,805.00).  Phase two of the project began sooner than expected and costs for this phase were not included in the current Fiscal Year 2018-19 adopted budget.

 

Staff recommends that your Board approve the plans and specifications for phase one the Fortuna Veterans Hall Americans with Disabilities Act (ADA) Project and adopt the supplemental budget for the ADA Compliance budget unit.

 

FINANCIAL IMPACT:

The total cost for phase one of the Fortuna Veterans Hall Project is estimated at $359,805. In Fiscal Year 2017-18, the county paid $25,565 for design services and site preparation. The ADA Compliance budget (3552-152) included $155,000 in its Fiscal Year 2018-19 budget for the first phase of this project. ADA compliance design for phase two of this project is estimate to be $13,800. A supplemental budget is needed due to costs exceeding original cost estimates for phase one and for unanticipated costs for phase two in the amount of $194,000. The ADA Compliance ISF (3552) has a current balance of approximately $848,759 and has sufficient funds for the supplemental budget request.

 

The item before you today supports your Boards’ strategic framework of fostering transparent, accessible, welcoming and user friendly services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

Your Board could choose to not approve the plans and bid authorization and supplemental budget; however, the county may be subject to fines for non-compliance, as phase one of the Fortuna Veterans Hall project is identified by the DOJ in the Consent Decree with ADA barriers that must be removed prior to the termination of the consent decree and phase two ADA barriers were identified in the subsequent ADA Full Assessment report.
