Recommendation
That the Board of Supervisors delegate the authority to sign legal conflict waivers on behalf of the County to County Counsel subject to notification to the Board.

DISCUSSION:
There are times when it is necessary to obtain a written waiver of a conflict of interest in a legal case involving the County. County Counsel is in a unique position to evaluate the risks and benefits of such a waiver and to weigh those interests; in the interest of efficiency, the Board should delegate this duty to County Counsel.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
Your Board could choose not to delegate this authority to County Counsel, however this is not recommended because there are often associated time constraints and calling a special meeting of the Board for that purpose would result in unnecessary delays and expenditures of public funds.
