That the Board of Supervisors:
1. Approve the supplemental budget to transfer $400,000 from the Current Planning Trust Account (3575 EIR Contractors) to 1100277-9101 Transfer in Revenue and 1100277-2118 Professional Services Expenditure. (4/5 vote required)

DISCUSSION:
In order to close the final expenses associated with the Humboldt Wind LLC project, the Planning and Building Department is requesting to transfer $400,000.00 from the Current Planning Trust account (3575 EIR Contractors). Humboldt Wind currently has a total of $426,798.86 on deposit for staff and consultant work related to processing the conditional use permit. With the denial of the conditional use permit, staff and consultants are submitting final costs.
FINANCIAL IMPACT:
Final costs are estimated at $400,000. There is no impact to the General Fund. All costs have been borne by the applicant.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose to deny this supplemental budget request. However, this is not recommended as there are professional service agreements in place for consultant services related to this project and the applicant is responsible for payment of those fees.
