RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Receive the Amended Analysis and Recommendations on the Humboldt County Reform Initiative; and
2. Provide other direction to staff as appropriate.

SOURCE OF FUNDING:
This is an unreimbursed expense affecting the cannabis budget unit (268). There is no allocation for this work in 268 the cost will be allocated to Budget unit 277. The cost of preparing this response is approximately $3,000.

DISCUSSION:
The Board of Supervisors received a letter dated April 20, 2023, from Kevin Bundy of Shute, Mihaly & Weinberger LLP in response to the Analysis and Recommendations on the Humboldt Cannabis Reform Initiative (HCRI) presented to the Board of Supervisors on the March 7, 2023. This letter has been reviewed and responses to the comments are embedded in an Amended Analysis (Attachment 1). If the Board is satisfied with the responses, the Amended Analysis can be received, and no further action is necessary.

At the Board of Supervisors meeting on March 7, 2023, the Board considered the Analysis and Recommendations of the Humboldt Cannabis Reform Initiative (HCRI). The Board formed an Ad Hoc consisting of Supervisor Arroyo and Supervisor Bushnell with the purpose of determining if there were alternatives to be explored that would allow for the HCRI to be removed from the March 2024 ballot with the hope of developing a balanced approach. As the consultation between the Ad Hoc and the Initiative Sponsors was ending, the Sponsors issued a letter dated April 20, 2023, expressing concern with the HCRI Analysis and Recommendations.
