Recommendation
That the Board of Supervisors:
1. Direct the Clerk of the Board to Correct the Effective Date on Page 1 of Ordinance No. 2681 which amended Title III, Division 3, Chapter 1.5 of Humboldt County Code pertaining to Accessory Dwelling Units.

SOURCE OF FUNDING:
Funding for this amendment is through a Local Early Action Planning (LEAP) grant program awarded in 2020, and through the Long Range Planning unit, 1100-282.
DISCUSSION:
On Aug. 10, 2021, your Board of Supervisors adopted Ordinance No. 2681 amending the Inland version of the Humboldt County Code regarding accessory dwelling units. A post-adoption summary was published. Subsequently staff noted that the ordinance stated it would become effective immediately upon adoption instead of 30 days after adoption. No actions have been taken pursuant to the ordinance amendments; staff has treated the ordinance as becoming effective 30 days after adoption.
To remedy this error, staff recommends that the Board of Supervisors direct the Clerk of the Board to correct the effective date on page 1 of Ordinance No. 2681 so that Section 3. Effective Date states: "This ordinance shall become effective 30 days after its passage." A corrected version of Ordinance No. 2681 is attached as Attachment 1. The ordinance will have become effective by the time this agenda item reaches your Board; this action item is intended to ensure there is a clear legislative record.
FINANCIAL IMPACT:
There is negligible financial impact as a result of this change to the effective date of the ordinance.
