RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to sign the attached Memorandum of Understanding between the County and California Health and Recovery Solutions to be backdated effective October 19, 2022. (attachment 1);
2. Authorize the Sheriff or Correctional Captain to execute any and all subsequent amendments to the attached Agreement after review and approval by County Counsel, Risk Management and the County Administrative Office;
3. Direct the Clerk of the Board to return one fully executed original copy of the attached Agreement to the Sheriff's Office for further processing.
4. Approve a supplemental budget for FY2022-23 (attachment 2) (4/5 vote required).

DISCUSSION:
California Health and Recovery Solutions ("CHRS") has contracted with the Department of State Hospitals ("DSH") to provide treatment for all those incarcerated individuals that have been deemed incompetent to stand trial by the courts. This treatment is to occur in county jails while the incarcerated individuals await placement in the State Hospital.

This Memorandum of Understanding is an agreement between the County and CHRS to provide the necessary space and provide, "Corrections Services" for the treatment team to serve the incarcerated individuals awaiting placement in the State Hospital. This program is extremely beneficial as it will get those individuals treatment similar to what they will receive at the State Hospital. In many cases, by intervening as soon as the courts have deemed an individual incompetent, the treatment team is able to restore the individual to competency without the individual ever going to the state hospital.
