Amendments to the Inland and Coastal Zoning Regulations to Amend Sections 313-111 and 314-112 to Update the Density Bonus Regulations consistent with Current State Requirements Established Within California Government Code Section 65915 and 65915.5. RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Adopt the resolutions (Attachments 1 and 2) which do the following:
a. Find the amendments to the Zoning Regulations are exempt from CEQA pursuant to Section 15061(b)(3) of the state CEQA Guidelines (common sense exemption), and that the coastal version is exempt from CEQA pursuant to Section 15265 (adoption of coastal plans and programs); and
b. Find the amendments to the Density Bonus Ordinance comply with the General Plan, local coastal program, and Coastal Act; and
c. Find the amendments to the Density Bonus Ordinance are in the public interest; and
d. Find the amendments to the Density Bonus Ordinance are consistent with the purpose of the ordinance; and
2. Adopt the ordinance amending Title III, Division 1, Chapter 4 of Humboldt County Code, Sections 314-112, 314-136 through 314-157 (Attachment 3.A., Inland); and
3. Adopt the ordinance amending Title III, Division 1, Chapter 3 of Humboldt County Code, Sections 313-111, 313-136 through 313-157 (Attachment 3.B., Coastal)
4. Direct the Clerk of the Board to publish a post-adoption summary of the Inland Amendments to the Density Bonus Ordinance within 15 days after adoption by the Board, and to post in the Office of the Cler...
