RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:

1. Grant a waiver of the Humboldt County Nuclear-Free Ordinance with regard to the attached participation agreement with the California Mental Health Services Authority;
2. Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached participation agreement with the California Mental Health Services Authority regarding the County of Humboldt's involvement in the Inter-Member Transfer Program;
3. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached participation agreement with the California Mental Health Services Authority after review and approval by County Counsel, Risk Management and the County Administrative Office; and
4. Direct the Clerk of the Board to return one (1) fully executed copy of the attached participation agreement with the California Mental Health Services Authority to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
Under Section 14717.1 of the California Welfare and Institutions Code, when a foster youth needing Specialty Mental Health Services ("SMHS") is placed in a County other than where they currently reside, responsibility for, including the cost of, providing SMHS promptly transfers from the county of original jurisdiction ("sending county") to the county in which the foster youth has been transferred ("receiving county").
